WORKMEN'S COMPENSATION BOARD "Arising out of and in the cause of employment' & "A vital consideration in deciding eleigibility for ben- efits under Ontario's Work- men's Compensation system is establishing that injury is the result of an incident "arising out of and in the course of employment." On the surface a relatively straight-forward provision, its correct interpretation is fundamental to fair applica- tion of Workmen's Compen- sation. Fair application in this instance requires not only that workmen be adequately protected but also that employers, who finance the "system through their contri- butions, are not saddled with costs for conditions which are not the result of employ- ment. In general, coverage ex- tends to anything connected with performance of the task for which the worker was hired or to which he has been assigned, including an act- ivity which may not have been specifically designated but which might reasonably be undertaken in connection with his duties. If the worker acts rea- sonably and in good faith attempting to do what he believes to be in the best interest of his employer, the fact he may to some degree exceed his instructions or go outside the strict limits of ordinary duty does not necessarily deprive him of Workmen's Compensation coverage. Broad as the above in- terpretation may appear, it is not an unlimited blanket extending Workmen's Com- pensation protection to every conceivable eventuality. A worker whose injury is caused solely by his own serious and wilful miscon- duct is not entitled to compensation unless the in- jury results in death or - serious disablement. Likewise, injuries suffered while engaged in horseplay or as a result of a fight are not considered to arise out of employment. However, there have been rulings under which workers injured as a result of horseplay in which they did not partici- pate, or fights in which they either did not retaliate or were in fact innocent vic- tims, have received Workmen's Compensation benefits. Where there is any ques- tion, the injury-causing inci- dent is one arising out of and in the course of employment, a decision on eligibility is not infrequently an exremely delicate matter which can be resolved justly only after careful examination of re- ports covering every aspect of a particular case. In such instances it is very important the incident be reported in detail, and also as soon after the occurrrence as possible so that an enquiry may be carried out while events are fresh in the minds of witnesses and physical evidence may be examined first hand.
