2 -- PORT PERRY STAR -- Monday, Dec. 22, 1975 "Happy Landings" is the message written on the back of a picture of Jeff Cox in the Evil Knievel costume he wore for the Western Weekend parade last August. It's not the message, but who it's from that has caught the eight-year-old boy by surprise. It's signed by Evil Knievel of Butte, Montana. The family sent the picture to Montana about four months ago with no reply until last Wednesday, when they found the signed picture in the mail. Mr. Noel had resorted to private prosecution when Ottawa O.P.P. declined to lay a charge following the mishap, at Constance Bay, about 25 miles west of Ottawa. In dismissing the charge, the judge agreed with the, defence lawyer's contention' that Mr. Noel's evidence had shown the landlord was tres- - passing, causing damage and was adamant in his refusal to leave. Mr. Cafik was not required to testify. Unchallenged testimony included evidence that Mr. Cafik struck Mr. Noel three times with'a broom from the rear. Two of the blows drew blood from the landlord's head. However, Mr. Noel admitt- ed he refused to leave the property despite several requests by the accused. The landlord then went to Mr. Cafik's back yard where he used scissors to cut down clothes lines which he felt were damaging the bark of trees. Mr. Noel continued to cut down the clothes lines while Wr FRIENDLY piraroonee ns: WHEN 1 HEAR ABOUT AN - "OUTSPOKEN WOMAN..,| AM CURIOUS TO SEE THE MAN THAT OUTSPOKE HER... Jl WAGG BROS. Under the circumstances, Judge Hutton said, "I don't think I could ever find that the force that was used was more than was necessary." He said an individual is entitled to use reasonable force to protect his private property.
