(2) That Schedule "A" to By-law Number 2585 is hereby amended as follows: (i) So that the portions of the streets so designated on Schedule "A-1' annexed to this By-law shall have a Planned Width of Street Allowance of 86 feet and not as heretofore designated on the said Schedule HAY and, (ii) So that the streets so designated on Schedule ""A-1"" annexed to this By-law shall have the "Planned Width of 'Street Allow- ance" deleted. (3) That sub-paragraph (ii) of paragraph (b) of subsection (2) of Section 17 of By-law Number 2585 (Distance from Lot Line) is hereby repealed and the following substituted therefore; 17(2) (b) (ii) Front Yard and Exterior Side Yard No front yard or exterior side yard is required except, (A) Where a building or structure has a height in excess of 45 feet, a front yard or exterior side yard, or both, as the case may be, of a distance equal to one-third of the height of the building or structure shall be provided, and (B) Where a lot abuts any of the streets listed hereunder, no portion of any building or structure shall be located thereon closer than 43 feet to the centreline of such streets, namely: Mary Street, Colborne Street, Green Street, Frances Street, Byron Street, Perry Street. (4) That this By-law shall come into force on the date it is passed by the Council of the Town of Whitby subject to the approval of the Ontario Municipal Board. The purpose and effect of By-law Number 452-77 is to amend Restricted Area (Zoning) By-law 2585 to reduce the planned width of street allowance on certain streets covered by By-law Number 2585, to redefine the provisions of Section 6(14), "Planned Width of Street Allowance" and to establish a minimum setback from certain streets for non residential uses in the C-3, Central Commercial Zone.
