The decision by council ~followed a presentation~by Mrs. Lillian Truax whose property is adjacent to part of the park. She said that on recent weekends there have been as many as 3,000 people in the park area, and that some are trespassing "on her property," throwing" garbage and beer bottles on her land, and in one in- stance, intimidated her son with abusive language. Councillor Don" Crosier told council that he looked into the complaint last Sun- day and said that there was "at least 200 cars' parked along the fence of Mrs. Truax'- property, and that "each one had a bar-b-que going". ZONING PROBLEM Cedar Stone Park consists of about 29 acres, with nine acres close to Highway 12 zoned open space which per- mits use as a park and picnic area. The remaining 20 acres which runs to the Truax property is zoned agriculture and existing zoning regulations do not permit use -as-a park and picnic area. - Mrs. Truax asked council to enforce this zoning re- striction or at least compel the park owners to erect a proper fence to keep the park users off her property. Councillor Richard Drew expressed reservations that the Township -can tell the park owners that they could not allow picnickers to use the back 20 acres. "If people want to walk on this land, we can't stop them. We probably can't even stop them from picnicking on land zoned agriculture," he said. Councillor Vern Asselstine disagreed, however. "We must enforce the zoning re- strictions." He stressed that the Township does have the power to regulate the' use of land under zoning regulations, regardless of who owns it, or how they might want to use it." Councillor Asselstine then moved a motion that the council ask the Township lawyer how the zoning regulations could be enfor- ced, but he got no support for the motion. Mr. C. Miller told council that he owns a double lot on MacDonald Street, each with a house on it, and that he is now in the process of selling off one of the lots. However, because both lots are legally registered in his name, they are considered as a single lot by the Town- ship and subject to the $1,000 severance fee. Mr. Miller argued that because there are existing houses on the two proper- ties he should not be subject to this fee. During the discussion councillor Jerry Taylor asked whether it has been the policy of the Town- ship to collect this fee for severances where there is an existing house, and was told by Clerk Doreen Van Camp that in similar cases in the past the levy had not been collected. Mr. Miller, visibly upset, said the decision was '"'un- just and unfair'. - He asked if there was an appeal pro- cedure and was told that there is through the Ontario Municipal Board. He then asked how many cases there have been similar to his where the severance levy has not been collected, and was told that this information would be in the minutes of past council meetings.
