(The OMB Decision is on the opposite page.) THE CORPORATION OF THE TOWNSHIP OF SCUGOG BY-LAW NUMBER 77-79 BEING A BY-LAW TO AMEND RESTRICTED AREA BY-LAW NUMBER 29-74 OF THE TOWNSHIP OF SCUGOG TO CHANGE THE ZONE DESIGNATION OF CERTAIN LANDS SITUATE ON THE EAST SIDE OF WATER STREET. WHEREAS it is deemed advisable to amend Restricted Area By-Law No. 29-74 to re-zone the subject properties to permit a public library and open space uses; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF SCUGOG Enacts As Follows: 1. That Schedule "A" to By-Law No. 29-74 of The Township of Scugog be amended as follows: . (a) By changing from C4 to P-112 those lands shown lined vertically on Schedule "A" attached hereto and forming part of this By-Law. (b) By changing from C4 to Ol those lands shown lined hori- zontally on Schedule "A" attached hereto and forming part of this By-Law. 2. That Section 29 of By-Law No. 29-74 be amended by the addition thereto of the following: . Exception Numbers (used with various zoning classifications as shown on Schedule "A™) "112 . Provisions The land may only be used for a public library and uses accessory thereto and parking." -3. In all other respects:By-Law Number 29-74 shall remain the _ same. i 4. This By-Law shall come into full force and effect on the date of passing subject to the approval of the Ontario Municipal Board. THE CORPORATION OF THE TOWNSHIP OF SCUGOG BY-LAW NUMBER 51-80 BEING A BY-LAW TO AMEND RESTRICTED AREA BY-LAW NO. 77-79 BEING A BY-LAW TO AMEND BY-LAW NO. 29-74. WHEREAS the Council of the Corporation of the Township of Scugog enacted By-Law No. 77-79 to amend Restricted Area By-law No. 29-74 so as to allow for the development of a public library and park facilities on Parts One and Two respectively of Plan 40R-5446, the subject lands being located adjacent the more easterly limit of Water Street, north of Queen Street; AND WHEREAS Restricted Area By-law No. 77-79 served to rezone Part One of Plan 40R-5446 within the Public Exception 112 (P-112) Zone whereunder the uses permitted are restricted to that of only a public library and such other accessory uses as are normally considered incidental and subordinate thereto, including parking facilities; AND WHEREAS Restricted Area By-law No. 77-79 served to rezone Part Two of Plan 40R-5446 within the Open Space (01) Zone and thereby provided for the development and use of such lands for recreational and parkland purposes in accordance with the provisions of that Zone; AND WHEREAS the Council of the Corporation of the Township of Scugog considers it advisable to amend By-law No. 77-79 insofar as is necessary to incorporate specific provisions to regulate the development and use of Part One of Plan 40R-5446 which is zohed within the Public Exception (P-112) Zone for the ~ purposes of a public library. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF SCUGOG Enacts As Follows: ~ 1. THAT Section 29 of Restricted Area By-law No. 29-74, as amended by By-law No. 77-79, is hereby further amended by deleting reference to the Exception No. 112 and inserting therefor the following: Exception No. 112. (C4)ZONE TO THE PUBLIC EXCEPTION 112 (P-112) ZONE . LAMPS TO BE REZONED FROM THE RECREATINAL COMMERCIAL (C4) ZONE TO THE OPEN SPACE (OI) ZONE (a) Permitted Uses The uses permitted shall be restricted to that of only a public library together with such other accessory uses as are normally considered incidental and subordinate thereto. For thé purposes of this By-law, a public library shall mean a public library within-the meaning of The Public Libraries Act, R.S.0. 1970, c. 381, as amended. (b) Regulatory Provisions No building, structure or use permitted within the Public Exception (P-112) Zone shall be erected, altered or used ex- cept in accordance with the Site Plan attached hereto as Schedule "A" and the following provisions, namely: i. Minimum Lot Area Requirement - 3,270 sq. metres ii. Minimum Lot Frontage Requirement - 68.58 metres iii. Minimum Front Yard Depth - 10 metres iv. Minimum Interior Side Yard Width Minimum interior side yard requirement shall be 8.0 metres on one side and 28.0 metres on the other side as specified oy Sehediie "A" attached hereto and forming part of this y-law. v. Minimum Rear Yard Depth - 14 metres (Sponsored by a Group of Concerned and Progressive Citizens.) vi. Maximum Lot Coverage - 30 per cent vii. Minimum Landscaped Open Space Requirement - 50 per cent viii. Maximum Height of All Buildings - 10 metres ix. Parking Space Requirements . i A minimum of 18 parking spaces shall be provided, as delineated on the Site Plan attached hereto as Schedule "A" and forming part of this By-law, provided that no parking-space-or-portion-thereof-is-located- within 1.5 metres of any lot line or within 3.0 metres of any street line. x. Other Zone Provisions a In all other respects, the provisions of the Public (p) Zone shall apply to regulate the development and use of those lands affected by this By-law. 2. THAT this By-law shall become effective on the date of passing thereof by the Council of the Corporation of the Township of Scugog, subject to the approval of the Ontario Municipal Board.
