EA ACRE Scugog Island property owner takes marina to Supreme Court A Platten Island property owner has launched legal _ action in the Supreme Court of Ontario against Goreski Summer Resort and Marina on Scugog Island. In a statement of claim filed with the Supreme Court earlier this month, Dr. Vladimir Nikolajevich al- leges that the marina and campsite operations "have contravened Township zoning by-laws and that reclaimed land as a result of dredging operations by Goreski Resort Ltd. does not belong to the marina" and campsite. - The statement also asks for a declaration from the court that all commercial activity on the lands cease; $150,000 for special damages for loss of value of the plaintiff's property, and $50,000 for general nuisance damages. - : The statement was filed by the Toronto law firm of Jarvis, Blott, Fejer and Pepino, and although no date for court has been set, the lawyers for Dr. Nikolajevich request that the matter be heard in court in Durham Region. : - Dr. Nikolajevich has own- ed property on Platten Island since 1976. Platten Island is a strip of land bétween the Goreski Marina and Lake Scugog, connected by a short causeway to Scugog Island. There are several cottages and perma- nent homes on Platten Island. The launching of the legal . action in Supreme Court comes in the middle of an Ontario Municipal Board hearing into a re-zoning which would permit Goreski Resorts to expand its camp- site operation to the east of the existing campground. The OMB heard a single day of testimony into the re-zoning March 12, but the hearing was adjourned at that time and slated to re- convene for more testimony on May 21. . In a letter to the chairman of the OMB, lawyers for Dr. Nikolajevich have asked that the May 21 hearing be adjourned pending the out- come of the action in the Supreme Court. The statement of claim Liquor licence (From page 2) meeting that in June 1976, Cartwright had voted by , plebicite to allow licenced dining establishments, and he suggested that as long as zoning, health, and building code regulations are met, the granting of a licence and control should be up to the Licencing Board. He did mention the municipality has the power to control the kinds of entertainment in a licenced restaurant. At one point during the meeting Mayor Taylor took pains to explain that he was - not arguing in favour of the licence. "I'm not trying to defend this (application) or appear that I'm fighting in favour of liquor," he stated. Regional councillor Law- rence Malcolm acknow- ledged that a "wet vote" had carried five years ago, but he added this doesn't mean a licenced restaurant is des-. irable in any location in the municipality. "If the people of Caesarea believe this licenced rest- aurant would be a drawback to their community, then I'm prepared to support them," he said. - Councillor Espey stated that this particular licence application might be unique because of the nature of Cae- sarea with narrow streets, and a lot of young children, especially during summer months. : "The Licencing Board has asked council for some im- put into the matter,' he said. Whether Frank's Restaur- ant gets its liquor licence is still up to the Liquor Licen- cing Board. It is not known when the Board will re-. convene to make a decision one way or another on the matter, but it is expected in the near future. A letter expressing the concerns of council on behalf of Mr. Sharpe and théCaes- area residents at the meet- ing was mailed immediately to the Board.
