Court of appeal rules in favour of Goreski's The Ontario Court of Appeal has ruled in favour of the Goreski Sum- mer Resort Ltd. on Scugog Island by over-ruling an earlier court award of $20,000 in damages to a nearby property owner for alleged nuisance caused by the operation of the marina. The Appeal Court handed down its decision on December 5, over- turning a decision of a year ago by Madame Justice Van Camp who had awarded the $20,000 damages to Dr. Vladimir Nikolajevich. A spokesperson for the Goreski resort and marina said they are pleased with the Court of Appeal rul- ing and are hopeful that this has finally put an end to court actions against the marina which began some 16 years ago. Dr. Nikolajevich owns property on Platten Island on the west side of a channel used by boaters to get to the Goreski Marina on the Scugog Island. The law suits started in 1970 when Dr. Nikolajevich first sued the Goreskis. That law suit was settled in 1972 after three days of trial when the Goreskis quit claimed the tip of Platten Island to Dr. Nikolajevich and for his part, he acknowledged the Goreskis' right to operate the marina which had opened in 1967. A second law suit commenced by a number of owners of cottages on Platten Island claiming the marina caused a nuisance was dismissed in 1978 by Mr. Justice O'Leary after a 9 day trial. The Goreskis were subject to a third lawsuit in 1981. This was in- itiated by Dr. Nikolajevich, the plaintiff in the first action. The third action was commenced on the eve of an Ontario Municipal Board hear- ing called to approve the Township of Scugog's zoning by-law specifical- ly enacted for the purpose of recognizing the existing Goreski Marina and trailer park operation and to permit for its expansion. The Ontario Municipal Board after hearing objections from a number of Platten Island residents refused to approve the by-law but this decision was overruled by the Ontario Cabinet. Hot apple cider helped warm them up, but mostly it was the Christmas spirit that melted the frost, inspired by the holiday music that drifted into town and across the lake, a brightly lit Christmas tree on the Bandshell, and the companion- ship of family, friends and neighbours. Organized by Port Perry resident Barb Goodman, aided by her friends and family, the evening was a celebration of the Christmas season, an old-fashioned testimony to carol singing from days gone by.
