OMB ruling worries Mayor McPhail The Mayor of Brock Township is worried that a recent ruling by the Ontario Municipal Board may open the door for part-time farm- ers who hold other jobs to obtain retirement lot severances from their rural properties. Mayor Allan McPhail voiced his concerns during a meeting of Regional council February 24 in, Whitby. Referring to the OMB decision of January 15, he asked whether the ruling could carry weight in future similar cases. "I think this (OMB ruling) opens a real can of worms and it could be a problem for the rural Townships," he stated. The ruling he was referring to involved a man who owned 100 acres of land in the Region since 1964, but worked in the inspec- tions department at General Mo- tors. When he retired from GM in 1982, he applied to the Land Di- vision Committee to sever a lot under the farm retirement sever- ance provisions. This was denied on the grounds that the applicant was not a "bona fide farmer." The man appealed that decision to. the Municipal Board which ruled in his favour and the sever- ance was granted. In its ruling the OMB found that even though the applicant worked off the farm, he had over the years-expended a-considerable amount of time and effort at the farm, and as a result could be con- sidered a bona fide farmer. The man admitted that the farm- ing operation was not sufficient to support a family without the income from his GM job. Mayor McPhail wondered about the definition of a significant amount of time and effort on the farm as a requirement for a sever- ance. He noted there are hundreds of people in the Region who own rural land, engage in some farm- ing, but whose principal occupa- tion is away from the land. Would this case set a precedent for all these people to appeal to the OMB for a retirement farm lot severance, he wondered. Responding to the Mayor's questions, Dr. Mofeed Michacl, Durham Region's commissioner of planning said this specific deci- sion is not 'binding on future OMB rulings. Mayor McPhail was not con- vinced. He said that this ruling would be "pretty persuasive cvi- dence" at any future OMB hcar- ings of a similar nature.
