Metro will not enter into the GTA until it has completed a waste manage- ment master plan process, why is Durham so eager? From a judicial standpoint, the ability of the GTA to exist as a legally viable body, without so much as a piece of establishin legislation, is unsure. In effect the GTA is only a proposal until the council is empowered by Regional and Provincial legislature. The GTA assumes that the province will willingly give re- gional governments the power to impose tighter controls on curbside waste separation. In many ways it appears to be im- posing itself as a fifth level of government, somewhere between regional and provincial, without the consent of any constituency. For Durham to enter into the GTA may represent a breach with the existing Official Plan and may be illegal until that plan is revised or amended. The OP calls for a full examination of any development under both the Environmental Assessment Act and the Envionmental Protection Act. The current fast-track solution requires an exception to EA procedure that is in direct violation to the Official Plan and contrary to the spirit of both legislations. The Official Plan also calls for prior consultation with the host municipality and a planning process which includes finding alternatives. The Whitevale site was offered by the Province, and accepted by the Region without asking Pickering's okay. The GTA has been taking apparent liberties, entering into negotiations to purchase airports in Greater Toronto. A logical next step will be negotiations with the Federal government to purchase the "airport" lands in Pickering for long term dumpsite. Councillor Clark, from Ajax, made some strong points against the GTA in council. public accountability, there is no enabling legislation outlining its powers and controls, no defined structure to its operations. The business of the GTA has been conducted behind closed doors, with no avenue of public access to minutes of the meetings or any public participation in what negotiations occur between the five regional chairmen and the province. What about the problem of all members of the GTA steering committee being appointed, -or the issue of votes being based upon population, giving MetroToronto a clear majority? There are many questions left unanswered, many crises to come.
