Mr. Sorbara's announcement follows passage of Bill 194, the Smoking in the Workplace Act, which received third reading in the legislature recently. First introduced November 30, 1988, the legislation will prohibit smoking in enclosed Ontario workplaces under provincial jurisdiction, except in smoking areas specifically designated by employers. The amendments include: * a new definition of what con- stitutes a designated smoking area to ensure that the area is stationary; * an obligation on employers to make every reasonable effort to accomodate non-smoking employees who ask to work in a place separate from a designated smoking area; and * a provision which prohibits an employer from taking reprisal against an employee who has lodged a complaint under the Act. The legislation will cover all workplaces within provincial jurisdiction, encompassing ap- proximately 3.9 million workers at 233,000 workplaces -- more than 90 per cent of the province's workforce. These include retail, commer- cial, manufacturing and mining operations, hospitals, social ser- vice agencies and educational institutions. Residential workplace areas, such as hostels and detention cen- tres, will be excluded from the legislation, as will vehicles and areas in which the public is serv- ed, such as the public areas of restaurants. "Under this legislation, work areas in which smoking is permit- ted will be the exception rather than the rule,"' Mr. Sorbara said.
