It was this wording in the council resolution that ap- peared to have a bearing on the OMB ruling last week. Ms. Santos suggested in her ruling that wording such as that would leave ratepayers to assume the issue was dead. In March of this year, coun- cil gave approval to the by-law for 38 units, and ratepayers in the area were notified that the by-law had been passed. In May, Township council agreed to sell a portion of the un-opened road allowance of Cedar St. to the Diocese for $60,000, which would give the project more land and allow ac- cess via Ash St. to Highway 7A. There was a considerable amount of evidence given at the hearing last week about the ac- cess to the property via Ash Street. ' Several ratepayers testi- fied they were surprised to learn the by-law called for ac- cess via Ash St. Architect Alan Wylcox, who was involved in the plan- ning for the original 28 units, testified that preliminary sketches showing the Ash Street access were displayed at two public meetings held in front of the Township council. At one point during the hearing last week, lawyer Peter Lauwers, representing the Dio- cese, called the Ash Street ac- cess issue a "life-raft for the rat- epayers at this hearing." He said that even in the no- tice to appeal to the by-law the access "was not cited as a major problem" by the ratepayers. It is not known when the new by-law will be filed with the Township for council approval. The project has not had the unanimous support of the cur- rent council, with at least two members expressing reserva- tions about such things as park- ing and increased traffic, and the fact the building is so close to the Catholic Church and School. The fact that the approval progess for the new by-law is ack at square one, means rate- payers in the vicinity must be notified, there will be another public meeting, and if the by- law is approved by council, rate- payers have the option to ap- peal it to the Ontario Municipal Board "on its merits." No money for off-road parking Council voted to send a letter to Mr. Bill Brock informing him that they will not be spending any money on the parking lot at the rear of the building to help with the parking problems in downtown Port Perry. Negotiations began last Jan- uary to negotiate an agreement between the land owner and the township on improving the land for better use of parking. Councillor Cochrane report- ed that they were looking for some commitment from the Brock's on the land, and were only given a three year term. He said he did not feel that was long enough for the council to authorize JoRnShip money to be spent upgrading the parking on this property. Councillor Pearce said that since the township is now com- mitted to putting money into their own municipal lots, she didn't feel they should be spending money in the private sector for more parking.
