38 -- PORT PERRY STAR -- Tuesday, January 9, 1990 New legislation on smoking now in effect _ Labour Minister Gerry Phillips 1s encouraging employers to preparations now for On- tario's new smoking-in-the- workplace law which came; into effect Jan. 1, 1990. "Ontario is the first province to regulate smoking in the workplace," Mr. Phillips said. "This law enhances the govern- ment's effort to create a smoke- free environment in Ontario." The law prohibits smoking in enclosed Ontario workplaces under provincial jurisdiction ex- cept in smoking areas designated by the employer. Designated areas in which smoking is permit- ted cannot exceed 25 percent of the total space of the workplace. "This is a straightforward piece of legislation, which will be relatively easy for employers to implement, "Mr, Phillips said. "The law comes into effect Jan. 1 and employers must have their smoking-in-the-workplace policy in place by then." Mr. Phillips said employers should begin planning how they will meet the requirements of the legislation. If the employer decides not to designate a smoking area, smok- ing is prohibited in that workplace, he said. If the employer is thinking about designating smoking areas, he or she is required first to con- sult with the joint health and safe- ty committees at their place of business, or with a similar com- mittee in which employees par- ticipate or with the workers' health and safety representative. If there are not such commit- tees or a health and safety representative, the minister said experience shows that it still makes sense for employers to talk to their workers about the propos- ed policy. '"'Several employers have told me that this is a good opportuni- ty to find out the preferences of their employees and what pro- blems some individuals may have with tobacco smoke," he said. '""This puts the employer in a posi- _ tion to make an informed decision." If the employer decides to designate smoking areas, the maximum size of the area is limited to 25 per cent of the floor area of the workplace. Last year, Scugog did not take part in the Participaction Challenge. Two years ago, Scugog resi- dents were asked to phone in to let organizers know they had taken part in some activity. The law covers all workplace within provincial jurisdiction, en- compassing approximately 233,000 workplaces -- more than 90 per cent of the province's workforce. These include retail, commer- cial, manufacturing and mining operations, hospitals, social agen- cies and educational institutions. Residential workplace areas, such as hotels and detention cen- tres, will be excluded from the legislation, as will vehicles and areas in which the public is serv- ed, such as the public areas of restaurants.
