A group calling themselves the Concerned Citizens For The Preservation Of Parkland At Scugog Point has formed to ex- press their opposition to the planned development of the parkland which they have used for more than 50 years. According to Eric Johnston, the group's secretary, the con- troversy involves a 1.5-acre parcel of land purchased by the local residents in 1941 and placed in trust under a single person's name. Since that time it has been used as a park by the locals. Over the years, the lines of communication between the ex- ecutor and the group broke down, while the residents con- tinued to believe they were en- titled tothe land. It came as a shock to them when they learned the property had been sold and the new own- ers intended to rezone the land for residential purposes. Although the citizens claim they have a deed to the land as well as a receipt for the land, they know they have lost own- ership of it. Mr. Johnston admits it is the fault of the citizens that they lost the land. "It's apparent that we dropped the ball," he said. It is not the ownership of the land that the citizens are pro- testing however, but the planned rezoning of the land, Mr. Johnston says. - There is also some controver- sy surrounding the passing of the bylaw. In September 1990, a motion for the amendment was to be put before council. During a meeting Glenn Malcolm, ward 4 councillor who opposed the bill, asked if the matter was go-- ing before council, he was told no. Councillor Malcolm then left the meeting to attend to other business. Later in the meeting, the bill was intro- duced and passed. Mr. Malcolm told the Port Perry Star that he believes this was unfair, as "their (the citi- zens) side was not represent- ed." Although he concedes his presence probably would not ave changed the outcome of the vote, he would have liked to represent the people. The issue at hand is not the uestion of ownership, but of the land use. According to Mr. Johnston, the owner of the land wishes to build two homes on that property. The citizens are concerned that if two houses are put on that property it might develop a precedent for further residential building in the area. In an effort to block this de- velopment, the citizens attend- ed a meeting of the Ontario Mu- nicipal Board (OMB), last week in the Township of Scugog Mu- nicipal offices. According to Mr. Johnston, a planner testified under oath that a report on which council based its decision contained some inaccuracies, and there- fore it was "poor planning." Mr. Johnston says based on the new information, council should reverse its decision. Mr. Cuddie said there was no uestion of the ownership at the hearing, but the residents could still contest the issue. He also added that as far as the OMB was concerned, the bylaw was passed in accordance with the procedures. A decision will be reached in three to four weeks. In the meantime.
