The Rape Shield Law was designed in part to protect the equality of women who have been sexually assaulted, and provide them with equal benefit of the criminal law and equal protec- tions within the criminal justice system. Rape, and fear of rape functions cross-culturally as a tool of social control over women. This is not a gender neutral crime, nor a crime that affects both men and women equally. The member centers of the On- tario Coalition of Rape Crisis Centers are in a state of shock. We cannot believe that the highest court has decided that the rights of men are more important than the rights of women. When these cases were being heard at the Supreme Court level, we felt that it was appalling that the situation had gone this far. Now once again we must argue that women's sex- uality and sexual history do not have any relevance on the numerous assaults committed against us. The Supreme Court has just in- creased the many barriers and obstacles which stand in a woman's way when she considers reporting a sexual assault. We know that negative attitudes still abound against women who have been sexually assaulted. In our daily work we come across many who still believe that women lie about being raped, that women are sexual objects, that our "no" really means "yes," that we don't have a right to our bodies, that we really want to be raped, that we are not to be believed, and that if we are sexually active then we are somehow responsible for be- ing raped. In spite of the protections of- fered by the Rape Shield Law; judges still had the discretionary power to allow past sexual history as evidence if they found it rele- vant to the case. Not one man has been wrongly convicted for rape since the Rape Shield Law has been in place. To strike down the Cindy Thomas only protection women had against unjustifiable questioning in court about matters which are not relevant to her case is incomprehensible. It is evident to us that this is an indication of how the Right is gaining in this country, and how this trend is to the detriment to women. Just two months ago, Justice Beverley McLaughlin stated on the record that Canada's criminal justice system is biased towards men and (\ ha > nil er | te 1) against women. Today our Supreme Court, instead of begin- ning to rectify this deplorable situation, has given a very clear message to women: Your rights count less than the man who assaulted you.
