The ministry's Consumer Ser- vices Bureaus receive many complaints about driveway paving every year. '"'Much of the dissatisfac- tion results from householders expecting more than is reasonable from inexpensive jobs," says bureau expert Marilyn Gurevsky. "But some com- plaints come from people who've truly been taken by fly-by-night companies." At the other end of the scale, Gurevsky reports bureau staff also hear from consumers who've dealt with reputable firms, paid fair prices and still receiv- ed poor results. These are usually the easiest com- plaints to help resolve. The work will be covered by warranty, and honest com- panies will be glad to solve problems to protect their 'good names. To help consumers avoid difficulties with residential paving jobs, the ministry of- fers the following tips. Be wary of paving ser- vices sold door-to-door. During slow periods, a pav- ing company working in an area may ask around to see if more work is available in the neighborhood. But if you decide to hire one of these firms, check a few things before you sign a contract. -- Get a written estimate in- cluding the work involved, amounts and qualities of materials to be used and the size of the area to be paved. -- Call two other paving companies and ask for quotes based on the same specifications. -- Ask the contractor for references from last year's customers and recent ones, and contact a couple of each. Most problems will surface within a year after the work i; done, so if a driveway luid last June is still in good shape, chances are it'll last. At the most basic level, property rights in- clude the right to own, build upon, develop, sell, use and bequeath real estate. However, to date, govern- ment legislation regarding property rights has not been revised. In fact, in Ontario alone, there are more than 700 laws or parts of laws that directly affect the right to use and enjoy private pro- perty -- not including municipal laws such as zon- ing and planning. There is no provision for the protection of private property in Canada's Con- stitution. Nor is there any guarantee of a fair pro- cedure or compensation for the expropriation of property. While Realtors recognize the need for some legitimate restrictions on an individual's right to own property where the public good outweighs an in- dividual's right to private property, they feel there must be a balance between public good and private ownership. Basic property rights include: *the right to buy, hold and occupy real property; *the right to maintain privacy in your home by ex- cluding others from it; *the right to sell, rent, lease or give your property away; *the right to leave your property in any manner you desire; *the right to enjoy goods which from your land, such as agricultural produce; and *the right to destroy your property if you so desire.
