Manager A question that we are frequently asked, in respect to employee compensa- tion/hiring, is "can you hire someone to work for you and have a contract for an amount and not take payroll deductions etc.?" In other words they would be a con- tractor as opposed to being an employee. Quoting from Revenue Canada's employers' guide to payroll deductions: You are generally considered to be an employer if: eyou pay a salary, wages (including advances), bonuses, vacation pay, or tips to your employees; or eyou provide certain benefits such as board and lodging to your employees. An employer-employee relationship exists if you are in a position to control and direct the person or people who per- form the services. Although a written contract might expressly indicate that an individual is self-employed, the department might not necessarily con- sider the individual as such. You must examine the written contract and the working conditions to determine if the individual is self-employed. (end of quote) Should an employer be considering this matter they would be well advised to discuss this with their financial/legal advisor or contact their nearest Revenue Canada direct and discuss this with them and even better ask for a ruling. Farmers taking serious look at crop insurance this year As the 1995 growing season approaches, many farmers who did not buy crop insurance in the past are taking a serious look at the protection it pro- vides. Two main reasons for this are: 1. Many growers who did not buy crop insurance in the past were concerned that they would be under- written too low. Now farm- ers enroled in the Market Revenue Program only have an average farm yield based on four actual yields plus one underwrit- ten yield. In other words, their averages are at a lev- el which represents their production capability -- even more so if you include the effect of trending and buffering. After 1995, their average farm yield will be based solely on their own production records. 2. It just makes good business sense to insure because crop loss occurs every year in Ontario. Consider the following benefits of crop insurance: *Growers are guaran- teed up to 80 per cent of their average farm yield (85 per cent for corn and 90 per cent for soybeans); *The cost of insurance to the grower is one-half of the total premium cost; *Administrative costs are not reflected in premi- um costs; *Premium costs are tax deductible as an operating expense; and *Crop insurance pro- vides dependable collater- al with your lending insti- tution.
