The new law will be known as the Agricultural Marketing Programs Act (AMPA) and, among other things, it will replace by statute the previous gov- ernment's ad hoc "Cash Flow Enhancement Program" (CFEP), which is due to expire next year. Cash advances give farm- ers the flexibility to meet their expenses after har- vest and before crops are sold, despite what may be untimely market limita- tions or unfavourable pre- vailing prices when farm cash flow is needed. Cash advances have been provid- ed to- various groups of Canadian farmers for many years under separate pieces of federal legislation with different administra- tive requirements. : "Traditionally, these ad- vances were interest-free, until the previous govern- ment removed that feature from the law and left inter- est charges to be decided on an ad hoc basis from year- to-year through the CFEP," Mr. Goodale said. "Our new Act will reinstate sta- tutory certainty about the interest-free feature and will create a greater degree of equity among farmers in how cash advances are administered under vari- ous marketing systems throughout Canada." Qualified farmers will be eligible for an interest-free cash advance up to $50,000 through farm organiza- tions administering cash advance programs. Cash advances in excess of $50,000 to a maximum of $250,000 will also be avail- able at applicable interest rates. Four existing farm marketing Acts are amal- gamated in the new AMPA: - the Advance Payments for Crops Act, - the Prairie Grain Ad- vance Payments Act, - the Agricultural Prod- ucts Co-operative Mark- eting Act, and - the Agricultural Prod- ucts Board Act. In addition to cash advances, the new Act will update legislative authon- ty to provide farmers with minimum price guarantees and initial payments where products are marketed co- operatively, price pooling mechanisms, and other marketing tools dealing with intergovernmental sales and market failures. Prior to drafting this new legislation, the Govern- ment of Canada consulted extensively with farm groups in order to meet as many of their cash flow and marketing concerns as pos- sible. But as another step to ensure that the APMA is as good as it can be within existing fiscal constraints, the Minister has requested New farming legislation presented that the draft Act be sub- mitted -- before Second Reading in the Commons -- to the House Standing Committee on Agriculture and Agri-Food for further, final input and advice. The APMA is scheduled to be in force before the 1997 crop year. The CFEP will remain in place to ensure interest- free cash advances 1n tne meantime, as farmers expect.
