EE. 8- PORT PERRY STAR - Tuesday, December 16, 1997 "Scugog's Community Newspaper of Choice" McArthur may not cooperate, says his lawyer From page 1 ment for McArthur to co- operate in a court-ordered psychiatric assessment. Judge LaForme ordered the assessment to take place between Jan. 26 and March 26, and that it be carried out by noted crim- inologist and Queen's University professor Dr. Stephen J. Hucker. Lafontaine noted there 1s nothing to stop him from hiring an independent psy- chiatrist or psychologist to examine his client, and said he has not ruled out that course of action. McArthur, 45, was con- victed early in April on 17 charges stemming from the robbery and shootings at the Bank of Montreal in Port Perry on Oct. 20, 1994. Those convictions include five for attempted murder in the shooting that evening of three Durham Police officers, the bank manager and a real estate agent working in her office opposite the plaza on Hwy. 7A. All five survived their wounds. If eventually declared a dangerous offender, McArthur would be behind bars for an indeterminate length of time. There are now about 100 such offend- ers behind bars in Canada. McArthur will be back in front of Judge LaForme in a Whitby court room April 28, 1998 where the application will continue or he will be sentenced under normal laws for the Port Perry crimes. In handing down his ruling Monday afternoon to send McArthur for the assessment, Judge LaForme said in light of the "extraordinary mea- sures being sought" by the Crown, he should have as much up to date informa- tion on the offender as pos- sible. He said an assessment by a psychiatrist at this time is "important to this court." McArthur, with a lengthy record for violent crimes, 1s no stranger to' such assessments. Two were carried out by a psychiatrist and a psychologist in the early 1990's in connection with parole applications by McArthur. He has spent 29 of his 45 years in jail, on parole or on the run from the law. McArthur's 32-year old half brother Angus was also charged with the same 17 offenses in connection with the Port Perry crimes, but was acquitted on all 17 by the same jury that found "Micky" guilty.
