20- PORT PERRY STAR - Tuesday, March 17, 1998 "Scugog's Community Newspaper of Choice" - O'Toole seeks official recognition for Irish From page 1 country, said Mr. O'Toole, who added that perhaps the largest influx of people from the Emerald Isle occurred in the 1840's, when thou- sands fleeing famine in their homeland flocked to North American shores seeking a better life. And declaration of Irish Heritage Day would by no means be an exclu- sive measure, said Mr. O'Toole, who feels the val- ues imported by early set- tlers are still quite evi- dent today. "The Ontario Irish tommunity's cultural her- itage is an integral part of Canadian national cul- ture and identity and belongs, by right, to all Canadians of all back- grounds," he said. "Many of my con- stituents, who don't have any Irish background, tell me they become Irish for a day on St. Patrick's Day. "What better day than March 17 for all citizens of Ontario to celebrate our Irish heritage, and Join in on the festivities in the process?" Mr. O'Toole said he'll introduce his private member's bill when the legislature returns for its spring sitting. He's hoping for unani- mous consent from his Queen's Park colleagues. A judge is to announce a decision on whether or not a class action suit will proceed after hearing arguments Thursday in Newmarket. NI LO 1S 110000) 8 Ruling on Victorian Village lawsuit will come soon: judge From page 1 where all the solicitors involved reside, and then be transferred to Whitby for any civil trial that might follow. Lou Shulman, lawyer for Ribcor, argued that there were no unusual circumstances that required motions to be heard in Newmarket court, as they were that day. Mr. Shulman argued that hearing the case motions in Newmarket "would cause greater expense to all the par- ties." Steven Stieber, lawyer for the township, won- dered aloud in his argu- ment if Mr. Baert had leaned to an out-of-town court to gain an advan- tage. "My only concern would be whether bring- ing it (the certification) before a judge where you (Baert) have had some success before is to be considered," he said. Justice Jenkins' reac- tion to the comments was swift and stern. The jus- tice said that "to suggest judge shopping... well, I find that distasteful ..." After a brief recess, Justice Jenkins ruled that motions would be heard before him in Newmarket. For the rest of the afternoon lawyers for all sides argued whether a class.action suit 1s war- ranted in the matter. Late in the afternoon, Justice Jenkins stopped Mr. Baert's argument and announced that he had heard enough, and would reserve decision in the matter. He has also reserved decision on the merits of a $1 million counter claim of defamation, entered against Mrs. Bunn by Ribcor. Mr. Baert sought to have that claim held up until a decision in the class action suit is made. Justice Jenkins assured all parties he will decide on the matter as soon as possible. Whichever way he decides appeals are likely, and it will be a long time before Diane Bunn sees an end to her battle. News to report? Call The Star first for coverage: 985-7383 -_y INCREASE WARMTH.
