D. Gordon Malcolm, 45, of Old Scugog Rd. in Blackstock, bore the scars of the attack when he made a brief court appear- ance in Oshawa Friday morning. Malcolm was sporting a black right eye and slightly swollen face and nose, marks that weren't evident at his last court appearance a week earlier. He was still dressed in the bright yellow sweater he wore more a month ago, when on April 17 he was arrested by OPP and Durham Regional Police at an Oshawa motel. The man looked expectantly around the packed courtroom from his seat in the prisoner's box, then kept his head down throughout most of the brief pro- ceedings. He was remanded in custody until another appearance next Monday (May 25). Malcolm's lawyer, John Payne, said outside the court that he couldn't go into details about his client's injuries. He said, though, that it was his understand- ing an investigation into them was under way at the Whitby Jail, where Malcolm is being held without bail. "It is my understanding that the mat- ter is being looked into," Mr. Payne sald. "And, naturally, more secure arrangements are being made for my client and his safety." Whitby Jail superintendent Craig Maher told the Star that while he can't comment on individual cases, he could confirm that an assault on an inmate occurred. "Yes, there is an investigation ongoing at the jail regarding an alleged assault on an inmate," he said. "It is our policy to report any such incidents to the ministry (of corrections) to conduct an internal investigation and to notify the Durham police of incidents of this type," said the superintendent. g marks of jailhouse assault Mr. Maher said that any inmate officials at the facility feel is in danger could be segregated for his safety. Police allege that Gordon Malcolm was attempting to procure sex from a 12-year-old girl when he was arrested at the Oshawa motel last week.
