Neil Hart sustained a broken pelvis in the acci- dent. "This was a wanton disregard for the rules of the road," Judge Ronald Richards said in passing sentence. He favored Crown Attorney Lisa Cameron's request for a three to five-year term of incarceratign, saying the judgement must send a message to motorists: "There must be in this sentence a denun- ciation and a deterrent." The prison term does little to ease the pain for Mr. Burghgraef's family -- wife Sandra, daughters Melissa, 21, Jessica, 20, Rachel, 18, and son Joshua, 14 -- said Fred Burghgraef, Jim's father. "I find three and a half years of incar- ceration for an action involving death... that seems like a very mild sentence to me," he said, adding though that he takes comfort in the 13-year prohibition on driving awaiting Mr. Hart. And he allowed that no sentence Judge Richards could pass would heal the wounds of the family: "Nothing he could do is going to bring Jim back." Mrs. Burghgraef, surrounded by her children after the sentencing, said that while there's room in her heart for for- giveness, she feels a prison term for the driver is appropriate. "You have to remember, Shon did not go out purposely and hit Jim," she said. "(But) he shouldn't have been there on the road." She said that laying eyes on the man responsible for her husband's death for 'the first time Friday was difficult, but that she harbors no hatred for him. "I do not have the energy to hate," said Mrs. Burghgraef. "That wouldn't change anything. I have too many other things to worry about." She said, however, that a prison term for Shon Hart is necessary. "I sincerely hope that he makes some- thing of his life, and does not throw away the rest of his life." Mrs. Burghgraef has carried on the family business, Port Perry Auto Supply, with the help of her children and the "amazing" people on staff there. She said that while she and the kids have been undergoing counselling to help them deal with their loss, they feel the absence of Jim each minute of every day. "We talk about Jim all the time," she said. "He was there. We were together seven days a week. We worked together. We got up together." The accident was a shock to the com- munity, where many people have come to know Mr. Burghgraef over the years. He was on his way home after dropping off his son in Port Perry around 6:45 p.m. He and Sandra had plans to go out to a 50th anniversary celebration that Saturday night. A witness who was southbound on Simcoe St. south of Seagrave told police that she was travelling around 95 km an hour when Mr. Hart's pick-up passed her at a high rate of speed on a section of road marked by a solid yellow line, court was told. As the truck pulled into the lane to pass another vehicle Mr. Hart saw Mr. Burghgraef's oncoming northbound car. Both drivers steered for the shoulder, where the collision took place. Mr. Burghgraef died several hours later in hospital. Crown Attorney Cameron called for a stiff penitentiary term, citing the speed, dangerous driving, and lack of insurance on the vehicle. "The harm done by what [ would characterize as an irresponsible and selfish act is really incredible," said Ms Cameron. Mr. Hart's lawyer Brian Scott said his client accepts the blame for the tragedy, and that his guilty pleas reflect his contrition. "It's just a real tragedy and something Mr. Hart is responsible for, and he accepts that," said the lawyer.
