"A Family Tradition for 132 Years" ---- PORT PERRY STAR - Tuesday, November 24, 1998 - 9 By Chris Hall Port Perry Star The developers of West Shore Village have been served with a certificate for legal action over construction liens. Andrea Habas, the lawyer repre- senting Stoneport Construction Ltd., confirmed last week that the first steps have been taken in an attempt to secure payment for her client. In a lien filed last month with Whitby's Land Registry office, she alleges that West Shore Retirement Living Corp. still owes Stoneport Construction $623,585 out of a $2.4 million contract for work done on the site between August 1997 and Oct. 22, 1998. The company looks after the dry- walling and insulation as well as block and cement work at the site, which is located along the waterfront at the intersection of Simcoe and Perry Streets. West Shore Village is an adult retire- ment community comprised of life-lease bungalows and a large apartment block. "A statement of claim has been served and West Shore has 20 days to respond," Ms Habas said. The claim was officially filed Nov. 12. The next step, she continues, is for the two sides to get together and try to come to a resolution. "Once the dust clears, we'll see if we can sit down and come to a settlement under the Construction Lien Act and resolve the issues. "If not, we'll begin litigation and attempt to get back the money owing to my client." Caterina Gucciardi, a lawyer repre- senting West Shore Retirement Living Corp., said in a recent letter to The Star that the amounts of money owing could be subject to debate. - She said that "when a claim is advanced, the claims are based on alle- gations that must be proven in a court of law. The burden is on the plaintiff to prove its case." Ms Gucciardi said that Stoneport's claims are without foundation until proven in court, and indicated that West Shore will mount a defense against the claim. "There 1s sufficient ground to vigourously defend the claims asserted by the previous general contractor," she wrote. Ms Gucciardi said a management firm will be overseeing the project to completion, and pledged that other liens on the books will be settled quickly. Documents at the Land Registry office show that various companies have filed liens against the local devel- opment amounting to more than $800,000. On Nov. 10, Lafarge Canada Inc. filed a lien for $22,291.47 for ready-mix Lien claim at West Shore may go to court, says lawyer concrete supplied to the site between April 29 and Oct. 8 of this year. As well, Guido's Plumbing Mechanical Construction Ltd. altered the amount on a previously filed lien on Nov. 9. The Toronto company had been looking for a reimbursement of $19,500 on Oct. 20 for plumbing and heating work. Now, company president Guido DiMuzio is seeking a total of $118,105. 80 for plumbing work as well as a fire protection system for work done on the main building. Other lien claims filed against the project have come from Promark Aluminum ($39,943.10) and Port Perry's Oppers Aluminum Ltd. ($13,717.10). Ms Gucciardi said the project, approved by Scugog council several years ago, will be completed, and that disputes over payment will not hinder or delay construction.
