"I told the investigator that I was unavailable to be with my client that week due to commitments in court." Const. George had pre- viously given hours of interviews to the SIU investigating team. Const. George also gave interviews to the officers involved in the OPP investigation into the matter, that was requested by Durham Police, said Mr. Clewley. Mr. Clewley also claimed that he was called by another lawyer, Jimmy Lee, and told that Mr. Lee had been approached by SIU investigators to attend the interview in Mr. Clewley's absence. On Friday morning investigators arrived at 26 Division in Port Perry and, according to Mr. Clewley, "took Nancy into a room to try and inter- view her." Mr. Clewley said he was told by his client later that the investigators told her she was competent to make decisions without her lawyer present. Mr. Clewley said that Const. George told him the SIU investigators told her that she needed to "look out for herself and her own career." The SIU could neither confirm or deny what was said to Const. George. SIU spokesperson Gail Scala said there was no wrong doing on the part of investigators. "We are supportive of a witness officer's right to counsel," Ms Scala said. She went on to say, how- ever, that "she (Nancy George) cannot frustrate an investigation." Terry Ryan, head of the Durham Regional Police Association, backs Const. George and her attorney in their stance that no further interviews will be given by the officer, except through her lawyer. "Our position is that our officers act only on the advice of their coun- cil," Mr. Ryan said. "She (George) has han- dled herself above and beyond what was required of her and given the high stress she has experi- enced over this incident I commend her in her actions to date," Mr. Ryan said. George's actions under the Police Act. "I wouldn't want to say yes or no on that, but I can say that we will respect the officer and not ask for further inter- views with her," Ms Scala said. "You must keep in mind that statements she makes to us cannot be used against her." Mr. Clewley said he has sent a letter to SIU head Peter A. Tinsley, and is considering a complaint to the Law Society, of which Mr. Tinsley is a member. Above all, he said, his client will not speak again to SIU investigators. "I simply do not trust them not to try and under- mine her constitutional rights." Ms Scala said that the three-month probe into the police shootings is in its final stages, but could not give a time frame for its conclusion.
