David Doerfler, 35, was arrested and charged on Nov. 15 in relation to a he psychiatrist who bs. the accused dur- ing his 30-day mental assessment at a Whitby hospital can testify before the court, Crown Attorney Sheila Cressman said last week. "I have called the evi- dence I'm going to call," she told The Star. "It is the defence attorney's decision to call in the psychiatrist who examined David Doerfler after he was arrested." However, due to the psychiatrist's schedule, the next hearing in the Doerfler trial will not be 'province' S until July 6, she added. Defence attorney Ken Murray could not be reached for comment. An extensive investiga- tion was carried out by the Special Investigation's Unit (SIU), a body which looks into serious injury or death involving police officers. The three officers involved in the accident were found innocent of any wrong-doing. Mr. Doerfler faces a number of charges, includ- ing criminal negligence causing death and crimi- nal negligence causing injury, which were laid by the Ontario Provincial Police. Mr. Doerfler is also charged with one count of criminal harassment, one count of possession of a controlled substance, and one count of breach of pro- bation. accident at the intersec- tion of Hwys. 7A and 12 that killed 47-year-old John Michael Gibbons, of Oshawa. | It is alleged that at the time of the accident Mr. Doerfler was attempting to flee from Durham Regional Police officers. During Mr. Doerfler's trial the court heard that he had been drinking prior to the accident, and that he suffers from manic depression. He has not been charged with impaired driving. The court also heard that the accused had been "in communication with his ex-wife that night, and was angered after their chance meeting at a Port Perry gas station. "So far they're look- ing fine," she said last Thursday. "We're get- ting the rain when we need it... on average you'd like to see an inch of rain a week, and we're getting about that right now. "They're sizing up pretty good and it should be a really good | year for strawberries." If the current weath- er conditions keep up, pickers could be making their way through the McKay's 20 acres of berries by June 20, she said. While she's quite cer- tain there wont be a repeat of last year's tremendous crop, Mrs. McKay is expecting this year's fruit to be better than average.
