"This family has been reduced by 50 per cent... by something that could have been avoided, easily avoided," Mr. Polley said. "His driving appeared to be fine -- perfectly within the confines of his lane -- and his speed was appropriate when something occurred to make him go in the other lane." Mr. Sack also reminded the judge that his client had only had a few beers, and was not the kind of person who would spend a night in a bar and then drive home.
