McClelland Port Perry Star Scugog councillors want guidance and more data from staff before deciding what action, if any, to take over alleged zoning infractions with the Starlite Bar and Grill on Highway 7A in Port Perry. A letter from an irate Orchard Rd. resident was presented at the last council meeting, charging that the municipality has failed to take action against the restaurant and bar, located in the same building as the Centennial Lanes bowl- ing alley. The letter contains a host of complaints about alleged infractions involv- ing parking, privacy fences, hours of operation of the bar, construction of an interior wall that sep- arates the bowling lanes from the Starlite busi- ness, and whether the business is legal under the current zoning on the property. Council has heard the same complaints before from several residents of Orchard Rd. whose prop- erties back onto the busi- ness. -. The township was in the process of starting legal proceedings when the owners of the Starlite filed an official applica- tion for a zoning amend- ment for commercial use. But when . the public hearing for that rezoning got under way about a month ago, council took the unusual step of adjourning it abruptly, on the grounds that the Starlite owner did not present specific plans on what kind of uses he wants for the property. Mayor Doug Moffatt told the owner to come back to resume the hear- ing when he had some- thing specific to tell coun- cil and the public. Since that adjourn- ment there has been no communication between Starlite management and the municipality, and a date for resumption of the rezoning hearing has yet to be set. The Orchard Rd. resi- dent says in the strongly worded letter that she has run out of patience waiting for the township to take action on her alle- gations. Scugog CEO Earl Cuddie said that if a municipality starts legal action and a judge learns that there is another way to sort out the problems - Durham Regional Police have charged an Uxbridge man with impaired driving after he was observed driving erratically Saturday morning near Port Perry. Shortly before 9 a.m. on Oct. 30, officers wit- nessed a vehicle travel- ling east on Scugog Line 6, weaving from one side of the road to the other. The driver nearly went through the stop sign at the intersection with Hwy. 12, but final- ly stopped, say police. He then sat at the intersection "for a con- siderable amount of time" before turning north on Hwy. 12, police said. Uxbridge man arrested for 'impaired driving on Line 6 The driver continued northbound for a short time before turning into a driveway, where, upon exiting the vehicle, he fell onto the front lawn, police say. The man was arrest- ed for impaired driving and taken to an Oshawa police station, where he refused to give a breath sample. A 42-year-old Uxbridge man has been charged with one count of impaired driving, one count of refusing a breath sample, one count of driving with no insurance, and one count of driving with no drivers' license. He will appear in an Oshawa court on Nov. 23. DAVID M. But Ward 2 rep Ken Carruthers said he believes it is time for the township to start legal action again as a way of forcing the Starlite owner to come up with a specific rezoning plan. Council learned Monday that in August the property was listed for sale at $1.15 million, and the listing showed' a zoning of mixed commer- cial uses.
