Durham District School Board superin- tendent for building and maintenance Jack Massey said that locating glass for the new $2 million addition has been a major problem. "The type of fire-tempered glass used in the interior and exterior doors has become a problem for us," Mr. Massey said. The boom in commercial building in the province means that specialty glass and some other materials like steel sheeting have to be back ordered. "Most of the work is proceeding on time," Mr. Massey said. "But some of the millwork (doors and trim) have yet to be completed, and we have had to make temporary provisions about the glass." Mr. Massey said that with the coopera- tion of the Scugog Fire Department and township council, the board has received permission to use other types of glass in some applications until the ordered materials arrive. He also said that going to other suppliers was not an option. Her argument to dis- miss the appeal was backed by Uxbridge Township, York Region, citizens groups and oth- ers. But, in its written decision, the three-man OMB panel, chaired by Doug Colbourne, said that to dismiss Jay-M's appeal without a hearing is unwarranted. The case went to the OMB on an appeal by Jay-M Holdings after Durham Region failed to respond within 90 days to developer Joey Tannenbaum"s request foran amendment to the region's Official Plan. The change would have allowed for expan- sion of Uxbridge's urban area, which in turn would allow the devel- opment to go ahead. Having made its deci- sion to allow the appeal process to continue, the OMB went on to say that the "requisite objectivi- ty and sense of propor- , tion" that normally tran- spire between litigants in such hearings "may be evaporating". "The chasm is immense," the board said, ordering all the lawyers involved in the case to co-operate with each other. The OMB also noted that the original hearing date of Feb. 14 didn't leave enough time for the parties involved to prepare. Four days have been set aside, beginning May 23, to hear more legal arguments, to be followed by another two-day pre-hearing on June 26 at 10 a.m. at the community centre. At that time, the date for the actual hearing will be set.
