Mr. Zaparanuik was arrested a few days later as he left an Oshawa sen- tencing hearing on anoth- er matter, and Mr. Ball turned himself into police after an arrest warrant was issued. Last Tuesday, the court heard testimony from Gregory Pugh, the regis- tered owner of the vehicle allegedly used by the sus- pects. Mr. Pugh said that he was driving his vehicle in the early morning hours of Oct. 15, 1999. Mr. Pugh said that nei- ther Mr. Zaparanuik nor Mr. Ball were with him the night in question. He said that in fact, two other peo- ple were with him in the vehicle. Defense lawyers Sean Fraser and Tom Balka called Stephen Ball's mother and a friend of Mr. Zaparanuik, who both tes- tified that the two men were in their respective homes until late on the night in question. In his closing remarks, Mr.Fraser said that the identification of the accused was "flawed from the start," and that the court should take into account the speed with which the incident occurred as well as "the adrenaline factor in offi- cers running with their guns drawn and being involved in a high speed chase," in their ability to positively identify the two accused. After the two men were acquitted, the drug charges were withdrawn. Charges of breach of a rec- ognizance were also dropped against the two men. Mr. Zaparanuik was returned to custody where, defense lawyers said, he has a few more days to serve on other matters. He was convicted of mischief for damages to a police cruiser during his arrest on the prostitution charges and given time served by Judge Richards. Stephen Ball left the court all smiles and in the company of his mother. He paused long enough to tell media, "I am very happy. | was wrongfully accused... here in this court today justice was done." Mr. Ball spent over three months in pre-trial custody after he was refused bail. In making the acquittal Judge Richards said "police have a responsibility to ensure integrity of the identification process."
