The SIU investigates all police actions involving the public that result in serious injury, sexual assault or death. The SIU was called to the intersec- tion of Hwy. 12 and 48 near Beaverton on Dec. 20, Subject officer forced to remain off-duty 1999 after a suspect was shot during a confronta- dion with police. A pursuit involving a suspect vehicle and Durham Regional Police began when officers were called to investigate a sus- picious vehicle at the Great Blue Heron Casino on Scugog Island. After being drdered several times to raise his hands into view of the offi- cers, Mr. Mclvor continued to attempt to drive the vehicle. The Crown who prose- cuted Mr. Mclvor said that at that point an officer fired through the wind- shield of the suspect vehi- cle. According to the agreed facts, Mr. Mclvor continued to "refuse to comply to orders from the officers," after having been struck by three bul- lets. Despite statements from the SIU that its inves- tigation was in its final stages on several occa- sions during the six months since the shoot- ing, a report on whether charges will be laid in the incident is still on hold. Gail Scala, media spokesperson for the SIU, said last Thursday that she is sympathetic to the problems caused by such a long investigation process. But the SIU has been delayed by several events in completing its report, she said. . "It is my understanding that the report is now in the hands of the director (Peter Tinsley) for his review," she said. "This case has presented sever- al problems for us that include the compiling of a very detailed accident reconstruction report that was some time in coming." Ms Scala said that the director can put no time frame on a conclusion to the investigation. "The director will now review the investigators' report very thoroughly and may have further questions or clarifications to request from the inves- tigators," Ms Scala said. "The director must be completely and utterly satisfied that he possess- es all the relevant facts before he will issue any decision." Only the director of the SIU can determine whether charges will be laid in the case or the offi- cer will be cleared of any wrongdoing. In the meantime, the officer designated as sub- ject officer in the incident remains off-duty.
