Hoskin can be heard on a recording made by the officers that night, talking to Enzo. Both York officers made tapes of the visit. As the officers make clear their inten- tion to arrest Enzo Romagnuolo, Tony can be heard to shout: "Your gonna arrest the whole family... Your gonna arrest the whole f--kin family." Const. Martin said that as Tony shout- ed the final line he struck the officer across the chest , and the confrontation escalated. "Things began to happen so fast at that point," Const. Martin told Mr. Humphrey. The last words by Const. Martin on the tape are a surprised shout of "Holy f--k... holy f--k!" Mr. Romagnuolo "brought up his right hand and struck me in the chest," Const. Martin testified. He said Mr. Romagnuolo stepped behind him, put him in a choke hold, and dragged him backwards. Const. Martin became emotional as he described being unable to breathe and turning around so that he could push Tony backwards into a car parked near the front porch of the house. Martin "I lost my footing... and | started to bend forward," Const. Martin said. "He reached down and put me into a choke hold with his right arm around my neck and locked with his left arm." Const. Martin said that after a brief struggle he managed to gasp: "You're choking me, | can't breathe, you're gonna kill me." According to Const. Martin, Mr. Romagnuolo responded by tightening his grip, and started trying to claw at the offi- cer's eyes while he screamed: "I'm gonna rip your f--king eyes out!" Const. Martin testified that he had lost his pepper spray during the struggle. "Why did you take out your gun?" Mr. Humphrey asked the officer. "I felt like 1 was going to pass out," Const. Martin said. "I drew my gun out and the only part of his body | could see was his legs, and | fired several shots. | was going to die; | was either going to pass out or he was going to choke me until | was dead," the officer said. The shots had little effect, said Const. Martin. He said Mr. Romagnuolo forced the Barretta .40 caliber pistol into his face. With his head as far back from the black hole of the pistol barrel as he could manage, Const. Martin said, "I was terri- fied." "I see the muzzle flash," Const. Martin said. "| forced the gun down toward his torso and | fired... and | fired until it wouldn't fire anymore." Mr. Humphrey asked the 38-year-old officer what his thoughts were as the struggle unfolded. "l just wanted to stop him from shoot- ing me, from killing me," Const. Martin said as his family looked on from the gallery. The court also heard from a bylaw offi- cer who told of two dealings with Tony Romagnuolo in which she felt he tried to "intimidate her." And a former hockey coach of middle son Rocco told of being so frightened of Tony after a run-in that he carried his son's hockey stick as he traveled to a parking lot afterwards. The coach said Tony threatened to "f--kin kill you.." in a dis- pute over the coach's cancellation of out- of-town games. York Const.
