McClelland Port Perry Star Scugog Township coun- cil has given final approval for the development of 35 residential lots just north of Port Perry. _ The development, known as Honey Heights, Phase Two, got the green light Nov. 27 at the final meeting of the council that has been in office for the last three years. The development agreement contains strin- gent requirements, aimed at protecting the wells of existing homes in the immediate area. Township planning con- sultant Jim Dyment told council that he is "very sat- isfied" with the terms of the agreement regarding protection of existing wells. "The situation is very well controlled in my view," he said. The development agreement stipulates that the developer, Fourteen Estates Ltd., will immedi- ately provide potable water to any homeowner complaining of well prob- lems. The developer will con- tinue to provide well water until independent tests determine the pre- cise cause of the well problems. If these independent tests determine that the well problems are a result of the new development, the developer will have full financial and legal responsibility to correct the problems. However, if the tests find the development not to be the cause of the problems, responsibility shifts to the homeowner. Mr. Dyment said the terms of the agreement relating to well water pro- tection are stricter than those required by Durham Region. He said both the region planning depart- ment and health unit have approved the agreement. He told councillors that each of the new lots developed will have a drilled well before build- ing and occupancy per- mits are issued. The development will take place on land in Ward I. Residents now living on Honey's Beach Rd. have expressed concern over the development and the potential for negative impacts on their wells. There have been consul- tations between the town- ship, the developer and existing residents during the course of the prepara- tion of the development agreement. Another requirement is the construction by the developer of an emer- gency access from one of the interior streets to Honey's Beach Rd. This access will be for emer- gency vehicles only, and will not be open for gener- al public use. It must meet the specifications and approval of the township fire department. The agreement also requires the developer to build a public walking trail over part of the the lands. It will be deeded to the municipality, will be for pedestrians only and must be constructed to prevent any kind of vehic- ular access, including' snowmobiles. The developer must provide a restrictive covenant on the land with- in 30 metres of the high water mark of Lake Scugog, which will prevent any grading or the removal of natural vegetation with- out the consent of the township and Kawartha Conservation.
