PORT PERRY "WEEKEND STAR" FRIDAY, APRIL 7, 2000 - 5 Man charged under new flight law A former Scugog resident has become the first person to be charged under a tough new law aimed at drivers who flee police. Bradley Emmerson, formerly of Cartwright and now of Birchfield Dr. in Courtice, faces a possible five-year sen- tence after a police chase that ended in a horrific crash in an Oshawa subdivision in the early morning hours of Monday (April 3). According to police reports, at approximately 3:25 a.m. police began the pursuit of a vehicle allegedly stolen from a gas bar in the vicinity of Taunton Rd. E. in Oshawa. Officers chased the 1999 Plymouth Neon until the driver lost control on a curve in a subdivision on Grandview Dr. N. in Oshawa. The chase lasted only min- utes. According to witnesses, the Plymouth rolled over and crashed into a van parked in a driveway on the residen- tial street. Reports said the crash was of such force that it awoke sleeping residents in surrounding homes. Police officers on the scene rendered assistance to the driver and a 17-year-old Oshawa youth, who was a passenger in the suspect car. Mr. Emmerson was subse- quently charged by police as being the alleged driver. Sgt. Jim Grimley, spokesperson for the Durham Regional Police, said that at last report the passenger of Student's bound for UN this summer the stolen vehicle remained at Sunnybrook Health Sciences Centre in a coma after undergoing surgery for life-threatening injuries. Under the new provincial legislation, which came into effect March 30, drivers who cause serious injury while fleeing police are liable to jail sentences of up to five years; those who cause death while fleeing police can receive.up to 14 years in prison. Counsel for Mr. Emmerson said that his client "is extremely upset and concerned for the welfare of his passenger, who is a close friend. At present that is fore- most in my client's mind." The province's Special Investigations Unit (SIU), which looks into all police incidents that result in death or serious injury, has begun an investigation into the events surrounding the pursuit. Durham police informed the SIU of the chase within minutes of the crash. Mr. Emmerson is charged with flight from police caus- ing bodily harm; driving while exceeding the legal blood-alcohol limit; criminal negligence causing bodily harm; impaired driving causing bodily harm; theft over $5,000, and possession of stolen property exceeding $5,000.
