The suit is the result of the 1998 shooting of Tony sons. The two York officers, Constables Randy Martin and Mike Hoskin, who were accompanied by two Durham officers, Constables Al Robins and Nancy George, were at the home of Tony Romagnuolo on the night of Dec. 28, 1998 to inves- tigate allegations of a threat against one of the York officers. Const. Martin was charged with second- degree murder while his partner, Const. Hoskin, faced assault . with "a weapon and other relat- ed charges. Durham Const. Robins faced charges of aggravated assault and discharging a firearm with intent to wound. ; All the officers were acquitted. The suit names sever- - al high-ranking SIU mem- bers, including SIU Director Peter Tinsley. The Durham Regional Police Association, which backed officer Robins in his court battle, said that the decision not to pur- sue malicious prosecu- tion allegations similar to those launched by the York association have nothing to do with the merits of the case, which has yet to be proven in a court. Terry Ryan, the out- spoken president of the Durham association, told The Star funds are at the root of their failure to launch civil action. "I have to be honest here, we (the DRPA) can- not put out the type of funds that the York asso- ciation can and still be able to protect our mem- bers against the possibil- ity of actions against them in regard to other matters that may come up," Mr. Ryan said. "We support the York associa- tion in its move and will 'be of any assistance to them we can." The police association has been critical in recent months of the SIU investigations over what . the association calls, "minor and self-explana- tory incidents involving Durham officers." None of the six SIU inquiries in the Durham area in the past seven months has resulted in a finding of any wrong- doing. The allegations in the 'suit by the two York offi- cers have yet to be proven in a court. No date for hearings has yet been announced.
