A. D. 1919. at 10 o'clock a. m. The meeting was called to order by the clerk and the roll being called the following members responded to their names, to-wit: H. H. Barber, D. M. Wright, H. E. Whipple, W. H. Ward, H. G. Durkee, E. C Hughes, E» F.-fCuecker, Charles H. Ackman, Jr., tlohn Conley, F. A. Walters, J, E. Harrison, H. '1C. Turner, L. B. Covell, H O. Hoffman, 8. H Freund and A. H. Ha)*, constituting a quorum. First in order bsing the election at a ehairman for the ensuing year, Su?. Harrison placed in nomination D. M. Wright, supervisor of Marengo township, said nomination was seconded by Sup. Walters, and there being no farther nominations, D. M. Wright was unanimously elected as chairman for the, enduing, year. The records of the last meeting were read and on motion approved. It was moved by Sup. Turner that the same rules adopted by the Board for the management of the. business of tho county for the past year be adopted by the Board ins the rules to govorn its action for this year; that the savne committees and the same number. on each committee be selected as the working force of this Board for the current year, that the present standing committees transact the business of the county at this meeting. Said motion was duly seconded and carried. The following claims for expen-joe of the various committees for expends of tlie Fourth Liberty Loan drive, presented at a former meeting and laid over for the attention of Mr. W. E. Joslvn, county chairman fhr McHenry county for the Fifth or Victory Loan drive, appeared and addressed the Board on tne matter of ail in paving necessary expenses Incurred in the prosecution of the drive, stated that in his opinion $500 would be sufficient to cover same, upon motion of gup. Walters, duly seconded, the said sum of $500 or so much thereof as necessary was appropriated to cover necessary expenses attending ssid drive Sup. Harrlsoh. Introduced the following resolution mad moved Its adoption, to-wlt: Resolved, by the County Board of McHenry County, that the section of public highway described ^aa follows: Beginning at a point on the public highway designated as proposed State Aid Road Route(s) No. 17, said point being Station 6.64 at intersection of center line State Aid Route 17 with aast city limits of Harvard and extending thence along said Route in a north easterly direction for a distance of 233G feet more or less, of which 2336 feet are to be improved, to be known as Section L, as initiated by the preliminary resolution of this Board, passed December 2, 1918, be improved as a State Aid Road in accordance with the plans and specifications as prepared by the Chief Highway Engineer, and that there has been appropriated from funds in the hands of the County Treasurer, the sum of Eleven thousand nine hundred sixty-eight and nollOO1 dollars, ($11968.00), which is to meet the allotment for the fiscal year ending June 30, 1918, or so much thereof as may be necessary to defray the county's portion of the cost of said improvement; and the County Clerk is hereby directed to transmit to the Department of Public Works and Buildings Division of Highways, a certified copy of this resolution, which shall constitute final notice. This action of the County Board be- Ing in accordance with sections 22 ana 24 of Article IV of "An Act to Revise the Law in Relation to Roards and Bridges,*' approved June 27, 1913, and all amendments thereto. Further resolved, that upon receipt of approved estimate by the Department of Public Works and Buildings the County Clerk be authorized to draw orders on the County Treasurer payable to the contractor in payment for the County's portion of said improvement. Contract not to be let until approved by County Board. Said motion to adopt was duly seconded and the resolution adopted. Sup. Whereas, the County Treasurer vi ' • ex-officio County Collector, will be J pared to make his final settlements With' i the various taxing bodies immediately after the sale and settlement of the delinquent taxes. And, whereas, the Attorney General Of this State has rendered various conflicting opinions as to the interpretation of the proviso in Section 243 of. • the revenue act relating to final sot- • tlements by the county collector with the various taxing bodies, as his opin- . ions in his report for 1917-1918 on pages 454, 466 and 1090 will bear evidence^ - said proviso as amended by the legislature two years ago. reading as f01>, lows: •"Provided that in counties under township organization, where no town collectors are elected, no fees or commissions shall be deducted by ttte county collector from taxes collected by him and heretofore authorized to ve collected by the town collectors, and all such taxes collected shall be paid over in full to the proper authorities or parsons authorised by law to receive the same." And Whereas, a construction of the law according to one opinion of the attorney general will cut off all tax collection fees of the County Trea»» urer's office, allowing him nothing for collecting the entire tax of the county. And, Whereas, the County Treasurer ^ has no other source of revenue sufficient to maintain his office and collect the taxes except the fees allowed in section 21 of the Fees and Salaries Act. And. Whereas, the County Clerk under section 18 of said Fees and Salaries Act Is entitled to his fees for computing and extending the taxes on the collector's books, but according to o*.# of the attorney general's opinions, i* >lso cut off from receiving any fees f%. doing this work. And. Whereas, the loss of thesi fees to the clerk and treasurer by a complete disbursement of all taxes to the taxing bodies would entail a large loss to the county, throwing all the cost of computing: extending and collecting tile taxes upon the county and the county clerk and treasurer for which no adequate appropriation has been made. It having been assumed from the opinions of the attorney general as generally accepted bj* the clerks and treasurers and the County Board as given on pages 454 and 466. that there would be sufficient funds to pay these charge* from the collections received.' \ And, Whereas, it will be Impossible for the County Treasurer to maintain his office out of his fees under the construction of the law as given on page* 1089 and 1090 of the attorney general's report. Whereas, it is manifestly unjust snd unfair to entail the burden of collecting the taxes upon the County Treasurer as ex-officio county collector of this county without remuneration therefor out of the collections reoelved. when in counties in this statQ Jjfrt JHWlee township organisation, the sheriff^ as ex-officio county collector In perrorming the .same duties, receives the full amount of the fees or commissions allowed in section 21 of the Fees and Salaries Act. and deducts the same from the taxes received. Therefore. Be It Resolved, by the Board of Supervisors of this County, that we protest against this extreme degree of unfairness which said section 243 Imposes upon the treasurer of counties under township organisation, and that we endorse and urgently request the passage of emergency legislation in the form of an amendment omitting the proviso from said sect Ion, thus giving to each county collector of the State, whether he be sheriff or treasurer the; same fees for the same duties without discrimination and to the county clerk his fees for making up the collectors books without discrimination as to counties under township organisation. Be It Further Resolved, that the clerk immediately transmit a certified copy of this resolution to the clerk of the House of Representatives and of the. The special committee on Cole bridge in the town of Burton made the following report which was on motion adopted, to-wit: Mr. Chairman and Gentlemen of ths Board of Supervisors of the County Of McHenry, Illinois: Your Committee to whom was deferred the matter of constructing a new bridge at the site known as the Cole" Bridge in section 30. Burton township Would beg leave to submit the following report on the matters before them: .That they met with the Highway Commissioner of the Town of Burton at the Cole Bridge on the eighth day of May, A. D. 1919. and decided that a new bridge of at least 80 feet clear water? way was necessary, and instructed C, L Tryon. county superintendent of highways to prepare plans and specifications: for said new bridge: and further it appearing that it would be necessaiy for Burton Township to raise its share . of the cost of said new bridge, by means other than money in hand from the regular Road and Bridge funds of said Town, your Committee deems it expedient that the County order said .- bridge buUt at the cost of the County - under section 34 Art. 5 of the Statate of this State.
