WHEREAS, the City of McHenry, McHenry County, Illinois, has outstanding and unpaid at this time public benefit judgments and other indebtedness not represented by bonds in an amount in excess of sixty thousand dollars ($60,000); and WHEREAS, said indebtedness was incurred by said City for lawful corporate purposes, as authorized by law, and said indebtedness is hereby found and determined to be the legal, binding and subsisting obligations of said City now outstanding and unpaid: and WHEREAS, litigation is contemplated to enforce the City to pay a |>ortion of said indebtedness out of current taxes within a short time; and WHEREAS,, the large amount of Indebtedness which this City owes Is embarrassing the credit of the rCity, and it is for the best interests of fhe City that such indebtedness be paid by the borrowing of money and the issuing of Funding Bonds therefor: and WHEREAS, this City does not have Sufficient funds on hand at this time, to be received in the near future, Sufficient to pay said public benefit Judgments and other indebtedness, ,,and it is necessary to borrow •ixty thousand dollars ($60,000) for Jth&t purpose: - NOW; THEREFORE, BE IT AND •.$T IS HEREBY ORDAINED by the *City Council of the City of McHenry, JtfcHenry County, Illinois: "; Section 1. THIS BOND is subject to registration as to principal in the name of the holder on the books of the City Treasurer of said City, such registration to be evidenced by notation by said Treasurer on the back hereof, and after such registration no transfer hereof, except upon such books and similarly noted hereon, shall be valid, unless the last registration shall have been to bearer. Registration of this bond shall not affect the negotiability of the coupons hereto attached, which shall continue negotiable by delivery merely, notwithstanding registration hereof. IN WITNESS WHEREOF, the said CITY OF McHENRY, by its City Council, has caused its corporate seal to be hereto affixed, and this bond to be signed by the Mayor, countersigned by the City Treasurer and attested by the City Clerk, and the coupons hereto attached to be signed, countersigned and attested by said officers, respectively, .by their respective .facsimile signatures, and said officers do, by the execution hereof, adopt as and for their own respective proper signatures GENERAL CORPORATE BOND KNOW ALL MEN BY THESE PRESENTS: That the City of McHENRY, in the County of McHenry and State of Illinois, hereby acknowledges itself to owe and, for value received, hereby promises to pay to the bearer or, if this bond be registered as to ownership, to the registered holder hereof the sum of ONE THOUSAND DOLLARS ($1,000), on the FIRST DAY OF MAY, 19...., together with interest on said sum from the date hereof until paid at the rate of FOUR AND THREE-QUARTERS per cent (4%%) per annum, payable on the first day of November, 1928, and semi-annually thereafter on the FIRST DAYS OF MAY AND OF NOVEMBER in each year, upon presentation and surrender of the interest coupons hereto attached as they severally become due and payable. Both principal of and interest on this bond are payable in lawful money of the United States of America at the CONTINENTAL NATIONAL BANK AND TRUST COMPANY OF CHICAGO, in the City of Chicago, State of Illinois. THIS BOND is one of an authorized issue of Sixty Thousand Dollars ($60,000), all of the same tenor and effect except as to maturity, and is issued by said City for the purpose of paying public benefit judgments and other indebtedness outstanding against said City of McHenry and unpaid at the date of the issuance hereof, issued pursuant to and under the authority of an Act of the General Assembly of the State of Illinois entitled: "An Act to provide for the incorporation of cities and villages," approved April 10, 1872, and all Acts amendatory thereof and supplementary thereto, and pursuant to and in conformity with an ordinance of said City of McHenry, duly and properly passed by the City Council thereof, approved and published as required by law, and submitted to and approved by a majority of the voters of said City voting at an election duly called and held for that purpose on the twentyfirst day of April, 1928. AND IT IS HEREBY CERTIFIED AND RECITED, -That it appears from the records of said City that all acts, conditions and things required by the constitution and the laws of the State of Illinois to exist or to be done precedent to and in the issuance of this bond and of ATTEST: City cierk, City of McHenry, IllinotB. That said bonds shall be executed as herein provided as soon after the passage hereof as may be, and thereupon delivered to the purchasers thereof, namely, Seipp, Princell and Company, Chicago, Illinois, upon receipt of the purchase price heretofore agreed upon, the same being not less than the par value of said bonds, the contract for sale thereof heretofore made being hereby ratified the duty of such County Cleric to annually, in and for each of the years 1928 to 1946, inclusive, ascertain tho rate per cent required to produce the aggregate tax hereinbefore provided to be levied for each of said years, respectively, and said Clerk shall ex tend the same for collection upon the tax books in connection with and in addition to the other taxes levied in and for each of said years, respectively, for general corporate purposes of said City, and in each of said years such annual tax shall be extended and collected for said City in like manner as taxes for general corporate purposes for each of said years are extended and collected, and, when collected, such taxes shall be used only for the purposes of paying principal of and interest on said bonds herein authorized when and as same mature, and such funds so received from such tax shall be held apart from the other funds of such City and shall constitute a trust fund for the above purpose. Section 6. That all ordinances, resolutions and orders, or parts thereof, in conflict with the provisions of this ordinance be and the same are hereby repealed. Section 7.
