Carpentier and Attorney General Latnam Castle regarding delinquent truck licenses. ' "Both the Secretary ef 8tate and the Attorney General have been importuned by letter, by intermediaries and by attorneys for truckers 'to settle' delinquent truck fees. Neither as a matter of law nor as a matter of good public morals may we settle these cases. "The Legislature of 1951 set a charge to be collected by the Secretary of State for the privi lege of using the highways. That schedule of fees was held in abeyance by reason of an injunction, which injunction was reyeised by the Supreme Court of Illinois, whose action was up- ,eld by the Supreme Court of the United States. "The Illinois Supreme Court pointed out the fee was not on the use of the highway but upon the privilege of using the highway regardless of how much or how little the privilege was exercised. The constitution of the State of Illinois precludes the remission of any debt owing the State. Thus, even though Individual cases may present hardship, » neither the Secretary of State nor the Attorney General may lawfully abate any amount now due and owing for the privilege for which truckers applied and which they were licensed to exercise in the year of 1952.
