Sauber District Director of Internal Revenue Wife Not a Dependent A woman came to the Internal Revenue office the other day for help in the preparation of her income tak return. She said that l^pr husband is the wage earner of the family, and that last summer she had a part-time Job from which she earned $100 and from which tax was .withheld. Her question was: "cotlld she file a separate return in order to claim the refund of the withholding on her wages while her husband claimed her exemption on his return?" The answer to her question was "no," since for income tax purposes a wife is not in the same category as a dependent. The , woman objected and pointed out that her husband always considered her as a dependent that he supported. Choice of Filing A married woman with gross income of less than $600 has the option cf (1) including suc'i income in a Joint return . with her husband, in which the exemptions of both spouses are claimed, or (2) filing a separate return for the purpose of claiming a refund of any tax withheld, wfhiie her husband also files a separate return, declaring only his own income, in which case he may not claim his wife as an exemption. The taxpayers may exercise the option which wfll result in the lesser taut. If they c*hoose to file jointly, her income, however small, must be included in the joint return. If no tax was withheld, she is not required to file a return; but if she does not, her husband may not claim her as an exemption. The husband may not file a separate return declaring his income only, and take exemptions for both himself and his wife while his wife files separately in order to get a refund, as indicated in the second choice above. In this procedure, some husbands have claimed that the wife is a dependent. However, for the purpose of the federal income tax law, the wife is never a dependent of the husbind, and ihe is entitled to claim her exemption only by reason of their marital relationship. He may claim her as ant e*i*i eniption (1) if a separate return is filed and the wife has no income, or (2) if a joint return is filed by the husband and wife.
