Sales taxes were the best source of revenue in thirty states, income taxes in fourteen States, motor fuel taxes in five states, and severance taxes in Louisiana. In fiscal 1965 Illinois found that its best source of state revenue was the R.O.T. (sales tax) and its related use, service occupation, and service use occupation, and service use taxes--best to the extent of approximately 51 percent. The 1965 General Assembly added another related tax by imposing a rate of 3% percent to the rental income received by persons engaged in the business of renting or leasing tangible personal property. This legislation is being tested in the courts. Thirty-eight states levy a general sales and gross receipts tax. In 1965, about one-third of the state legislatures passed sales tax measures for revenue-raising purposes. The thirty-eighth and thirty-ninth states to impose sales taxes Were Idaho on July 1 arid New York on Aug. 1. The Idaho tax is levied at a 3 percent rate on a base which includes food. The New York tax' is 2 percent, and food is excluded from the tax base. (The New York law also authorizes local sales taxes up to 3 percent which are state collected ) Many ask, "Why can't the Illinois 'sales' tax be removed from the sales of food?" The answer is that under the Uniformity clause of the Illinois ^State Constitution, the tax must apply equally to all sales of tangible personal property to final users. The first "sales" tax act in Illinois was ruled unconstitutional by our Illinois Supreme Court because of the exemption of sales of motor fuel and farm products. cat;e r the course and return your reports.
