Inc. l aw Regulates Sellers Of Retirement Sites The Illinois resident who plans to retire to another state and is thinking about invest­ ing in a retirement home de­ velopment should know some­ thing about the laws that pro­ tect him from developers whose tactics are questionable or downright illegal. • According to the Illinois State Bar association, both federal and state legislation has been enacted to deal with land in­ vestment problems, including two of the most common ones-- high pressure salesmen and the purchase of property sight un­ seen. One protection against un­ scrupulous dealers is the fed­ eral Interstate Land Sales Full Disclosure Act. This law, which became effective this'year re­ quires developers who sell land in interstate commerce or through the mails to register with the federal government in most cases. The federally registered land developer is required to fur­ nish each purchaser~with a de­ tailed report on the property, including a description of the subdivision, information con­ cerning uses for which the land is suitable, what must be done to develop it for a residence and what additional costs are in­ volved. The ISBA warns that the pros­ pective buyer should not sign a contract until he receives the developer's property report. According to the federal law, if the buyer signs the contract and then receves the report, he may void the sale anytime within 48 hours after receiving the re­ port. If he received the report prior to signing the contract, he has 48 hours in which to cancel provided he did not inspect the property before signing. No cancellation period is provided for the buyer who both received the report and inspected the property before signing the con­ tract. Illinois requires all foreign (meaning out-of-state) corpor­ ations operating in Illinois to register with the Secretary of State and it is one of five states (the others are Hawaii, New York, California and Florida) to require sellers of out-of- state land to disclose certain information to the buyer. In this respect, it somewhat duplicates the federal requirement. The LSBA offers this advice to anyone who intends to invest in a retirement development, whether to provide for a future retirement home or for spec­ ulative purposes: 1. Be wary of high pressure salesmen and advertising gim­ micks. One popular sales tech­ nique is to bffer a free vaca­ tion trip to the property. Be certain that "free" doesn't mean a one-way ticket unless you purchase some land. 2. Inspect the property. Don't rely on pictures, charts, and promises. A common ploy is the promise that other develop­ ments are being built nearby, and that these will increase the value <SF your investment.Check out any such information. 3. Read the property report. It should be sufficiently detailed and simple to reasonably assure the prospective purchaser that he will understand the material aspects of the offering and con­ ditions' of the property at the time the offering is made. 4. Do some sleuthing. Contact the local Better Business Bur­ eau orChamberofCommerceto learn the seller's reputation. Also check prices to see what other property is selling for in the area. Learn what local or­ dinances will affect your prop­ erty and the use you've planned for it. 5. Obtain a written contract. Be sure you understand its terms before you sign. "McHenry county's immun­ ization program aims at vac­ cinating one segment of the population to protect another to­ tally different group," says Ward Duel, administrator of the McHenry County Depart­ ment of Health. "Youngsters to be immun­ ized during the week of Jan. 19 are being vaccinated to save the lives and health of chil­ dren yet unborn, children of the next immediate generation since rubella strikes through pregnant women." School superintendents and principals are contacting Duel's office now to line up details of the program to be sure young­ sters in kindergarten through third grade are vaccinated. State and local public health officials stress that unless the K-3 school children are im­ munized, the threatened rubella epidemic appears inevitable. The disease strikes in cycles. Epidemics of rubella run in cy­ cles of 5-7 years. Previous epidemics were reported in 1964-65 and 1958-59. The spring of 1970 is seen as the start of the next two-year ep­ idemic. The McHenry County Depart - ment of Health and Mchenry County March of Dimes are uniting to vaccinate 10,000 chil­ dren in the county with the help of the State Department of Health immunization team. The vaccination is free, stresses Duel. The most susceptible carrier group is from one year old through nine years. Seventy- five per cent vaccination of this group should ayoid an epidemic. Since this campaign will reach only school children 5-9 years old, cooperation by 90 per cent of this age group is impera­ tive to control the epidemic threat, says Duel.
