How far should a court be able to go in its efforts to obtain information that is known only to be in the files of a newspaper or other news medium? The question is at the heart of a controversy, now going on in legal and journalistic circles, involving subpoenas to the press to provide information which could be essential or instrumental in the proper administration of justice. On their part, members of the press feel that if the courts can command access to in­ formation that news media would not freely give, this can only have a "chilling effect" on freedom of the press. They maintain: confidential sources of information would dry up, news reportersWould be looked upon as investigators for the government anif > law en­ forcement agencies, and the prog would find it impossible to ferret out wrong-doing in high places - or any place. On the other hand, it is pointed out, the courts have an obligation to the public to seek out evidence which might prove or disprove allegations made in criminal and civil proceedings. In some cases, the only known source of this information may be the verbal, pictorial, or printed information, published or unpublished, obtained by the press. Under such cir­ cumstances, it is asked, should the press have the right to withhold information, whether or not it was obtained under promises of confidentiality? According to the Illinois State Bar association, until recently Illinois had no law protecting a reporter's confidential sources and the issue, if it ever came up in a court at all, never got as far as a ruling by a court of ap­ peals. As of last September, however, Illinois does have a law which touches on the controversy, at least as it applies to confidential in­ formants. The law protects reporters from capricious or irresponsible efforts to obtain disclosure of their confidential sources. At the same time, it provides that a court may demand to know who supplied certain information to any newsman employed by a newspaper, television or radio station or other news medium under the following conditions: (1) Secrecy is not required by either state or federal statute. (2) All other - -available sources of the same in­ formation have been exhausted. (3) Disclosure of the in­ formation is essential to the protection of the public interest involved. In the final analysis, both the courts and the press recognize that a reporter's determination to protect his sources, at any cost, may be the deciding factor. The rttlnois law provides that his refusal to cooperate "may be adjudged in contempt of court and punished ac­ cordingly."
