\ Legal Notlds A N O R D I N A N C E R E G U L A T I N G E N ­ CROACHMENT ON PUBLIC RIGHT OF WAY IN THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS WHEREAS, the City of McHenry hereinafter known as the CITY, and the State of Illinois, acting by and through its Department of Tran­ sportation, Division of High­ ways, have entered into an agreement relative to the improvement of Waukegan Street (Illinois Route 120, FA Route 21, Sate Section 14 (W&RS-2), City Section 20C-S), from Meadow Avenue to Front Street (Illinois Route 31); and, WHEREAS, in order to facilitate said improvement, it is necessary for the City to adopt an ordinance regulating encroachments on the right of way for said improvement in accordance with the following definition: Roadway Right of way is defined as those areas existing or acquired by dedication or by fee simple for highway pur­ poses; also, the areas acquired by temporary easement during the time and easement is in effect; Project Right of Way is defined as those areas within the project right-of-way lines established jointly by the CITY and STATE, which will be free of encroachments except as hereinafter defined; Encroachment is defined as any building, fence, sign, or any other structure or object of any kind (with the exception of utilities and public road signs), which is placed, located, or maintained in, on, under, or over any portion of the project right of way or the roadway right of way where no project right-of-way line has been established; Permissible Encroachment is defined as any existing awning, marquee, advertising sign or similar overhanging structure supported from a building immediately adjacent to the limits of the platted street where there is a sidewalk extending to the building line and which does not impair the free and safe flow of traffic on the highway, the permissive retention of overhanging signs is not to be construed as being applicable to those signs supported from poles constructed outside the project right-of-way line and not confined by adjacent -buildings; Construction Easement Area is defined as that area lying between the project right-of- way limits and the platted street limits within which the CITY, by concurrence in the establishment of the project right-of-way lines, will permit the STATE to enter to perform all necessary construction operations; and, WHEREAS, representatives of the CITY and the STATE have, by visual inspection, cooperatively established project right-of-way lines and have mutually determined the disposition of encroachments; NOW, THEREFORE, BE IT ORDAINED, by the City of McHenry, McHenry County, Illinois: Section 1: It shall be unlawful for any person, firm or cor­ poration to erect or cause to be erected, to retain or cause to be retained, any EN­ CROACHMENT (herein above defined), except as provided in Section 3, within the limits of the project right of way or roadway right of way where no project right-of-way lines have been established. Section 2: Project right-of- way lines have been established at the following locations: Along the north and south sides of Waukegan Street at the right-of-way line. Section 3: Revocable permits have been issued by the CITY for the temporary retention of the following PERMISSIBLE ENCROACHMENTS (herein above defined): None Section 4: This ordinance is intended to and shall be in addition to all other ordinances, rules and regulations con­ cerning encroachments and shall not be construed as repealing or rescinding any other ordinance or part of any ordinance unless in direct conflict therewith. Section 5: Any person, firm or corporation violating this „ ordinance shall be fined not less than Fifty Dollars ($50.00) nor more than Five Hundred Dollars ($500.00) for each of­ fense, and a separate offense shall be deemed committed for each and every day during which a violation continues or exists. Section 6: This ordinance shall be published three time(s) within fifteen days after its passage, in a newspaper having a general circulation in the City of McHenry, Illinois, and shall be in full force and effect after its passage, publication, and approval as provided by law. That there be and is hereby levied upon all the taxable property within the corporate limits of said Village for the year 1972, in addition to the maximum of taxes authorized for general cor­ porate purposes, a garbage tax of no more than .14 percent of the full, fair, cash value as assessed or equalized by the Department of Revenue, pursuant to the provisions of Chapter 24, Section 11-19-4, Illinois Revised Statutes, 1961 as amended by Senate Bill 266 of the 1967 Legislative Session. Section II. That the Village Clerk be and hereby is directed to file a certified copy of the Ordinance with the Annual Tax Levy Ordinance for the fiscal year ending April 30, 1972, with the County Clerk of McHenry County, Illinois, as provided by law. Section III. That should any clause, sentence, paragraph or part of this Ordinance be declared by a court of com­ petent jurisdiction to be in­ valid, such decision shall not affect the validity of the Or­ dinance as a whole or any part thereof other than the part so declared to be invalid. Section IV. That this Or­ dinance shall be known as Ordinance No. 72-0-2. Section V. That the Village Clerk be and is hereby directed to have this Ordinance published in the manner provided by law. Section VI. That this Or­ dinance shall be in full force and effect from and after its passage, approval and publication in accordance with the Law. Richard J. There they visited her son, Harold, his wife, Gail; little Philip, who is three years old and got acquainted with the newest member of the family, Jeffrey, now four months old. A two day trip took them into California where they saw the 728-0267 magnificent Redwoods. They also took in many of the beautiful attractions of the northwest, including a day at the oceanside. VETERAN RETURNS It'll be home cookin' and Mom's apple pie for Tom Mrowka. Tom just returned from a long tour of duty with the U.S. Air Force in Taiwan. Welcome home, Tom. BELATED BIRTHDAYS We've got lots of belated birthday greetings to catch up on. Back on Aug. 26, that proud- new papa. Jack Liggett, celebrated a birthday. And on Aug. 27, young Kurt Scheib turned five years old and is pretty busy getting all ready to start kindergarten soon. Yesterday, Aug. 29, our bread winner, liuffy Puffy, blew out a few candles (as a matter of fact it was QUITE a few candles). As we sat on the beach at Wonder Woods Subdivision on Sunday, Aug. 20 and watched the 14th annual ski show, the comments we heard on both sides were such as these: "You couldn't see anything better at Coral Gables", and "The per­ formance at the Chicago lake shore can't compare".
