If that is the case, the Illinois State Bar association urges you to start planning your "state - now. Estate planning begins with the not-too-difficult process of identifying and evaluating your assets - house, car, insurance, profit sharing, pension plan, Social Security, any in vestments and what have you - to determine how well you are providing for your family and what you can do to improve the situation, if need be. The ISBA stresses the do-it- now importance of estate planning because lawyers are all too familiar with the disastrous results of procrastination « waiting for a more convenient time that never comes. The bar group cites one case - one of many - that illustrates the point: "For years John and Mary ran a highly profitable restaurant in the Midwest. They accumulated a nest egg which they planned to use for retirement. John died sud denly. It was discovered that he had (1) failed to leave a will, (2) neglected to register the business name of the restaurant propertly, and (3) failed to establish legally that his wife was his partner. "As a result, Mary had to engage in litigation to regain her rights to the business name and take other steps to set her affairs in order." There are so many Johns and Marys that estates totaling in the millions of dollars for which no will or other plan was made directing distribution, pile up in probate courts across the country every week. The courts must determine who shall receive the property according to state laws. What is true for married persons, of course, is equally true for the single or widowed persons. The fact is, estates of single persons or those without children are particularly vulnerable to the capriciousness of the law, however fair state laws of descent and property distribution try to be. Take the example of a widow who had no children and no will. She remarried, then died while packing her bags for a wedding trip. Her husband of a few days inherited her entire estate. Had she made a will • the simplest estate plan there is - she would have certainly provided for a niece and nephew with whom she was very close. They got nothing because Illinois law says*the entire estate of a childless person goes to the surviving spouse if the deceased leaves no will . v The basic objectives of an estate plan are to determine a goal for the financial security of your family, structure your estate to achieve this goal, designate the recipients of your estate and minimize the effect of state inheritance taxes and~ federal estate taxes. A first step in estate planning may be to draw up a memorandum which can serve as a basis of ( icussion and decision by you and your at torney. He will want to establish certain facts. For example, in the case of a husband and wife, he will want to know what, if any property is held in joint tenancy. Under joint tenancy ownership, a surviving tenant automatic ally is invested with a deceased tenant's interest in the property. Often, however, couples believe they own property as joint tenant when actually it is in the name of one spouse only. The memorandum may in clude a schedule of assets, how they are held and their gross and net value. The attorney will analyze your assets, your wishes as to these assets and suggest alternative methods for conveying them to your beneficiaries when the time comes, together with the tax consequences. Life insurance can be an important consideration in the estate plan. Especially while children are young and educational and other expenses are high, life insurance may be the backbone of an estate. It should be coordinated with other assets, such as death benefits or income payments froni pension plans, Social Security and any other income- producing assets, so that a certain level of financial security is maintained in relation to probable need.
