The Law Serves You Auto Seller Must Attest To Mileage On Odometer Any question as to whether the odometer reading of a used car is a truthful indicator of the miles traveled may soon be a thing of the past, according to the Illinois State Bar association. As of March 1, the ISBA said, the seller of a passenger car is required to execute a statement in which he in effect vouches for the odometer reading as being accurate and reliable or states that the actual mileage is "unknown." The written statement is required under a new federal law, known as the Motor Vehicle Information and Cost Savings act. With certain ex­ ceptions, it must be provided by the transferee, or seller, any time ownership of a motor vehicle changes hands "by purchase, gift, or any means other than by creation of a security interest". The law wouldn't require such a statement in cases where title to the automobile is transferred for the purpose < of obtaining a loan on the car or in the case of repossession. The law provides that the seller must state that the true mileage is "unknown" if he knows the reading on the odometer is different from the actual mileage traveled and that the difference is greater than that caused by any odometer calibration error. In addition to applying to used cars, the ISBA said the law applies to the sale of any new car as soon as it is sold for purposes other than resale. The statement is not required for sale of a new car by a manufacturer to the dealer or for resale by the dealer to another dealer. Certain types of vehicles are exempt from the disclosure requirements. In particular, the law does not apply to vehicles having a gross vehicle weight rating of more than 16,000 pounds, which would include most busses and trucks; to vehicles which are not self-propelled, such as trailers, or to antique vehicles, meaning those 25 years old or older. In the case of busses and similar heavy vehicles, mileage on the odometer is not particularly relevant since the service given during use is more indicative of condition and value and the service record is what is important to buyers. A) No. Since most tax­ payers are on the cash basis, practically all deductible ex­ penses, including tax pre­ parer fees, may be deducted only in the year they are paid. Thus, if you itemize deduc­ tions, you may deduct on your 1973 return the amount paid in 1973 to have your 1972 re­ turn prepared. Q) I had two jobs last year, and more than the maximum amount of social security tax was withheld from my pay. Can I claim the excess? A) Yes. If you worked for two or more employers during 1972 and more than $9,000 of your wages were subject to social security tax, you are entitled to claim the excess social security tax as a credit against your income tax. See your tax form instructions for details. However, if you worked for only one employer during 1972, and more than $468 in social security tax was withheld, you may not claim the excess as an income tax credit. Your employer should adjust this over-collection with you. Q) How can I tell if a contri­ bution to a particular organi­ zation is tax deductible? A) If you itemize de­ ductions, you may deduct contributions to organizations operated for religious, chari­ table or educational purposes. Q) I heard that there are five tests that must be met for a taxpayer to claim a person as a dependent. What are they? A) For a person to qualify as your dependent for 1972, the following tests must be met: 1) You must furnish over half of the dependent's total support during the calendar year; 2) Unless the person is less than 19 years of age at the end of the year or a full-time student during five months of the year, you may not claim him as a dependent if his gross income is $750 or more; 3) The person must be a member of your household and live with you for the entire year or be closely related to you; 4) He must be a U.S. citi­ zen or resident, or a resident of Canada, Mexico, American Samoa, Panama Canal Zone or the Republic of Panama for some part of the year; and 5) The person must not file a joint return unless one is not due but was filed merely to obtain a refund. PREDICTING HAILSTORMS What weather radars can and cannot do toward identifying and measuring hailstorms has been summarized in a report by the Illinois State Water Survey. "Illinois Radar Research for Hail Suppression Applications, 1967-1969," is authored by Stanley A. Changnon, Jr., head of the survey's atmospheric sciences section. Changnon concludes that ordinary weather radar systems identify an impending hailstorm but that more sophisticated radar systems are needed to detect and measure the amount and exact location of hail within a thunderstorm. Such detection is necessary for successful modification or "suppression" of a damaging hailstorm, he added. Changnon explained that radar-direction of cloud 1 seeding operations is needed in an area like Illinois because when hailstorm conditions \ prevail there are normally 1 many thunderstorms, each a potential hailstorm.
