Thomas Hanahan and others by a Federal grand jury on charges of extortion and mail fraud, many people have assumed that I would be appointed if Mr. Hanahan is convicted or steps aside until he is cleared. Since we were both nominated by the Democratic party of the 33rd district and ran on the same ticket for the office, one can understand the assumption. But it's wrong. Your readers may be interested in the actual procedure. "Under state law, an elective office is declared vacant if the incumbent is convicted of an "infamous crime." Thus, if convicted, Mr. Hanahan would lose his office of state representative. "By law, his successor would be appointed, within 30 days, by the Legislative committee of the Democratic party in the 33rd district. This committee is cotnposed of the Democratic party county chairmen of the five counties lying within the 33rd district. Their appointee would serve uhtil January, 1977. In choosing the successor, each of the five county chair men would have a vote equal to the number of votes cast in his county for Mr. Hanahan last month. "This much is clear. What follows is less clear, and very much in need of attention. "Mr. Hanahan is a precinct c o m m i t t e e m a n a n d Democratic party chairman of McHenry county. In the Nov. 5 election, he received 22,000 votes from McHenry county out of his total of 33,000 in the district. Thus, Mr. Hanahan would control two-thirds of the vote of the Legislative com mittee. In effect, he could name his own successor, even if the RESTAURANT : liiVliii WHERE THE & BELLY BUSTER WAS BORN • BREAKFAST ™>Y • LUNCHEON SPECIALS • DINNERS •PURE BEEF BURGERSl NO CHARGE FOR TAKE OI TS •FRIDAY SPECIALS SPAGHETTI A FISH DINNERS! STAFF PHOTOS-WAYNE GAY* ORD the last person to have anything to say about it. "But election law is a slip pery subject, being crafted by legislators greatly interested in keeping their jobs and their party power. "In Chicago, Alderman Thomas Keane was recently sentenced to five years in jail, but continues as 31st ward committeeman (equivalent to a county chairman) and has just nominated his wife to succeed him on the city council. Last year, two McHenry precinct committeemen, elected in their precincts, were allowed to keep their posts after conviction of a felony. "So it appears that if Mr. Hanahan resigns his office as state representative, or is convicted and the office is declared vacant, he can, by continuing as county chairman, control the Legislative com mittee and name his successor without consulting another person. "Your readers may believe, as I do, that this would be an obvious miscarriage of the electoral process, that if the law allows this, the law must be changed. They may agree with Charles Dickens, who wrote in Oliver Twist: 'If the law sup- Doses that," said Mr. Bumble. "The law is a ass, a idiot.'
