Mar. 23, li Legal Notice ORDINANCE NO. 61 SWIMMING POOL ORDINANCE WHEREAS, the Corporate authorities of the Village of McHenry Shores have fully considered the many problems posed by the construction, installation and maintenance of residential swimming pools within the Village; ana WHEREAS, it is deemed advisable by said authorities to establish standards for said construction, installation and maintenance so as to minimize dangers both to person and property, now therefore be it resolved by the President and Board of Trustees of the Village of McHenry Shores, McHenry County, Illinois as follows: Section I - Definitions (a) "Swimming Pool" is defined as a body of water in a natural, artificial or semi- artificial receptical or other container having a depth at any point of more than 24 (twenty- tour) inches, br a width of over 10 (ten) feet whether located indoors, outdoors, inground or above ground, or both, used or intended to be used for public, semi-public, or private swimming by adults or children, or both adults and children. (b) "Wading Pool" is defined as a body of water in any receptical. above ground of 24 • twenty four> inches or less in depth or a width at any point of no more than 10 (ten) feet, intended for private use <c) "Permanent Pool" is defined as all in-ground or partially in-ground pools and all above-ground pools not disassembled for each winter Section II - Construction Permit Required It shall be unlawful to proceed with the construction, installation, re-installation, enlargement or alteration of any swimming pool and ap purtenances within the Village unless a permit therefore shall have first been obtained from the Building and inning Of ficer Drawings, plans or sketches and accurately figured ncf complete be made explicit anc showing the lot -lines and in cluding information pertaining to the pool, walk, and fence construction, water supply system, drainage and water disposal systems, distances ana locations to any septic systems adjacent, and any electrical connections. No portion of a swimming pool tnat would be wholly or partially in ground shall be located at a distance less than 8 (eight) feet from any side or rear property line or "less than 25 (twenty five) feet from any portion of any septic system. No portion of a swimming pool that is located above ground shall be located at a distance less than 8 (eight) feet from any side or rear property line, or less than 5 (five) feet from any portion of any septic system Permanent pools will require only a one-time permit All above ground pools that are taken down and stored each year and re assembled in the same manner as originally approved need only a one-time permit. No permit is required for a Wading Pool. Section III - Permit Fees « The fee for the permit of a Swimming Pool shall be 10 (ten) cents per square foot of surface area of the pool as indicated on the application for permit. Section IV - Prior In stallations Any swimming pools con structed. installed, in operation or use prior to the adoption of these regulations shall comply with these regulations. The Building and Zoning Officer may extend for a period of 60 (sixty) days the com pliance with any regulation which he may consider in his judgment is not a hazard to the health, safety and welfare of the residents of this Village, provided such swimming pool does not become a puDlic nuisance. Section V - Inspection All swimming pools shall be subject to periodic inspections by the appropriate Village official. Section VI - Governmental Units Should any higher govern mental ImkJv such as the State; County, or f ederal government have jurisdiction in th<* regulating of Swimming Pools, such approval for the plans and specifications shall be obtained prior to the submitting of the plans and specifications to this Village and its Building and Zoning Officer for a permit. Should such governmental regulations be more restricted and mandatory, they shall be complied with Section VII - Design and Construction Requirements No swimming pool shall be constructed or maintained so that „ any water depth shall exceed 4 (four) feet above the natural grade of the land. All swimming pools shall be of the re-circulation type in which circulation of the water is maintained throughout" the pool by pumps; the water being drawn from the pool, filtered clarified and disinfected before returning to the pool Swimming pools shall be equipped with facilities for completely emptying the pool and the discharge of the pool water to the front ditch line of the property. Such discharge shall be at a rate not to erode the drainage ditch or become a public nuisance to neighboring properties. Section VIII -JRences AH outdoor swimming pools shall be completely enclosed by a fence. Such fences shall be erected along the periphery of the pool or the pool walks ad jacent to the pool. The swim ming pool fence is to be 5 (five) feet in height above grade level and constructed of no less than number 9 (nine) gauge woven wire mesh, with maximum 2 (two) inch openings, corrosion- resistant material or similar material approved by the Building and Zoning Officer. In no instance shall a fence be installed and enclosed in such a manner as to prohibit ob servation of the pool. All fence openings or points of entry into pool area enclosures shall be equipped with gates These gates shall be considered part of the fence. Gates shall have latches on the inside of the enclosure installed at a height within six (6) inches of the top to deter opening by small children. All fence posts shall be of material that is decay or corrosion resistant Section IX - Electrical Requirements All electrical installations provided for, installed, and used in conjunction with swimming pools, shall be in conformance with the current issue of the National Electrical Code. (a) No current carrying electrical conductors shall cross swimming pools, either overhead or underground or within 15 (fifteen) feet of such pools. (b) All metal fences, en closures or railings near or adjacent to swimming pools which might become elec trically alive as a result of contact with broken overhead electrical conductors or from any other cause shall be ef fectively grounded. (c) Any exterior, surface electrical current carrying devices within 25 (twenty five» feet of a swimming pool shall be connected to a ground fault circuit interrupter outlet Section X - Illegality It shall be deemed unlawful for any person, firm, or cor poration to construct, install or maintain any swimming pool in violation of the provision of this Ordinance Section XI - Penalty\ Any person, firm, dr cor poration violating any provisions of this ordinance shall be fined not less than $10 00 nor more than $500.00 for each offense; a separate of fense shall be deemed com mitted on each day during which the violation shall continue to exist. Violation of„ different provisions of this ordinance shall be deemed separate violations for pur poses of the assessment of the penalty hereunder Section XII - Severability If any provision of this Or dinance or application thereof to any person or circumstance shall be held invalid, such in validity shall not affect other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are declared to be severable. Section XIII - Repealer All ordinances, or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed.
