BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF McHENRY SHORES, as follows: Section I - Storage of Junk Prohibited The storing of junk trash and refuse on private property within the Village of McHenry Shores, where such storage is not specifically authorized cinder the provisions of the McHenry Snores Zoning Or- 9 dp nance, is hereby prohibited ajnd declared a nuisance. Section II - Definition ' Junk, trash and refuse are defined herein to include any and all waste matter, whether reuseable or not, which is of­ fensive to the public health, safety or to the esthetics of the neighborhood, and is specifically intended to include, but not be limited to, worn-out. wrecked and-or abandoned automobiles, trucks, tractors, machinery of any kind, any parts thereof, old ice boxes, refrigerators and stoves. An officer of the village shall investigate such charge, and if such nuisance exists, issue a notice to the owner or occupant of the property as provided in Section 4 of this Ordinance. Section IV - Notice of Violation Any police officer or other officer of the Village , of McHenry Shores upbn ob­ serving any violation of this Ordinance shall issue a notice directed to the owner of record of the property on which said nuisance occurs, as shown in the records of the Recorder of Deeds of McHenry County, or to the occupant of said property, or to Doth, which said notice shall describe the violation and shall establish a reasonable time limit for the abatement thereof by such owner or occupant, which time shall be not less than two (2) days nor more than ten (10) days after service of such notice. Section V - Service of Notice Any police officer or other officer of the Village of McHenry Shores shall serve the notice herein provided for upon the owner or occupant of the property where such nuisance exists, or upon both of them, and shall make his return upon a copy of such notice, showing the time of service, the person upon whom it was served and the manner in which it was served. In <he event that the owner or occuDant cannot be found for personal service, service may be made by at­ taching a copy of the notice upon tne premises in violation, and by mailing a copy by registered mail to the last known address of such owner or occupant. Section VI - Investigation . Immediately upon the ter­ mination of the time allowed in any such notice for the abatement of such nuisance, the police officer or other of­ ficer of the Village of McHenry Shores, who served or mailed such notice, or any other police officer or officer who shall be .assigned by the Village President shall invesitgate to determine whether or not such nuisance has been abated. Section VII - Abatement of Nuisance In the event the owner or occupant of the property where such nuisance exists has failed within the prescribed time to abate such nuisance, then the police officer or other officer of the Village of McHenry shores, who served or mailed such notice, or the person who filed an affidavit with the Village Clerk, or the other officer who investigated whether such nuisance has been abated, shall file a complaint charging violation of this ordinance With the Circuit Court for the ®<9th Judicial Circuit, or a magistrate thereof, charging violation of this Ordinance ana demanding that the owner of the property or the occupant thereof, or both, be punished as herein provided. Section VIII - Penalty Any property owner or any occupant of any property in the Village of McHenry Shores, who allows such storage on the property owned or occupied by him or her in violation of the provisions of this Ordinance shall be guilty of a misdemeanor, punishable by a fine not less than Ten ($10.00) Dollars, nor more than Five Hundred ($500.00) Dollars for each offense, and a separate offense/ shall be deemed committed on each day during or on which a violation occurs or continues. Section IX All Ordinances and parts of Ordinances in conflict herewith, to the extent of such conflict, are hereby repealed. Section X This Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
