Illinois 60014 • (81S) 459-2641 by Estolle Atwoll McHenry county and the surrounding area are noted throughout the state as par ticularly active in the humane field. The area includes Helping Paws, the Fox Valley Humane Education society, the Humane society of North Central Illinois (South Elgin shelter), - and the Illinois Hooved Animal Humane society. Each of these organizations received praise for achievement at the annual convention of the Illinois Federation of Humane societies held in Decatur recently, and attended by representatives of every Humane society in the state. All in attendance wer dedicated to the humane ethic and recognize the need for statewide cooperation. Members of each McHenry county organization were named officers of the board of the state group as they were honored collectively. Helping Paws recognizes the supporters who have contributed both hours as volunteer workers, and money, which helped to establish the organization as a worthy one. Remember Buttons, the sad- eyed Terrier whose haunting picture appeared Sept. 7? She has been adopted by Nancy Rysen and family who report that family and pet are very much in love and enjoying each other. Buttons has a fenced-in yard and all the love and at tention she needs. The thirty or more responses to her plea for a home show that there are a lot of good people who really care, and we are impressed with the way the silent majority speaks in an emergency. On Oct. 3 there will be a meeting of the education committee to discuss programs coming up. HP needs lots of help in this area and the meeting is open to the public. Discussion will cover school classroom presentations and plans to start neighborhood clubs with an animal theme. Those interested in children and in animals, and who can spare a few hours each month for these undertakings, are invited to attend. Date: Oct. 3, time: 7 to 9 p.m.; place: 95 Grant street, Crystal Lake. Please call Mary Nelson in the office, 459-2641, between 10 to 2 daily, for further information. Lawyers who represent defendants in criminal cases are special members of our intricate system of justice. As advocates for defendants who are accused of breaking society's laws, defense lawyers and their role in the criminal justice system are often misunderstood. The Illinois State Bar association says every lawyer is sworn to uphold a code of Professional Responsibility which requires the lawyer to "represent a client jealously within the bounds of the law." Failure by a lawyer to represent a client's interest to the fullest extent possible could be grounds for disciplinary action or for a lawsuit against the lawyer for malpractice. The following questions can be answered "true or false". They represent some of the most musunderstood aspects of criminal defense law. 1. If a defendant confides to his lawyer that he did indeed commit the crime, the lawyer must so advise the court. 2. When a person whq is accused of a crime asks a lawyer to represent him, the lawyer may refuse to defend the person. 3. It is the responsibility of the lawyer to determine whether or not the client is guilty of the crime. 4. It is the defense attorney's responsibility to make all major decisions about how the defense will be handled. The Illinois State Bar association provides the following answers to these four questions : 1. False. The lawyer may not disclose the client's admission of guilt to the court or to anyone else, although the lawyer may urge the client to change his plea to guilty. The accused has immunity from self- incrimination under the 5th amendment to the U.S. Con stitution, and the lawyer is bound by ethical and professional obligations not to reveal statements made by the accused in confidence. 2. True. It is up to the lawyer in private practice to decide whether to accept a particular case. However, the Constitution also says the accused has a right to legal counsel. Defen- its who are unable to pay for* f legal representation may have a court appointed lawyer. 3. False. The defense lawyer's responsibility is to be an advocate for the accused, doing everything within the law to clear the defendant of the charges. It is the responsibility of the prosecution to prove the defendant to be guilty beyond a reasonable doubt. It is up to the court - the judge or the jury - to determine guilt on the basis of the evidence presented by the prosecution and0the defense. 4. False. The attorney's responsibility is to advise the client about the various decisions that must be made, such as whether to plead guilty or not guilty. The lawyer should make sure the client fully understands the consequences of such decisions, but it is the client who must decide and bear the consequences. The Illinois State Bar association says the goal of insuring justice in our society demands that defendants be represented by competent legal counsel who vigorously fulfill their duties to their clients.
