The Municipal Code, City of McHenry, Illinois, be and the same is hereby amended by adding thereto the following as and for Chapter 27 thereof: SECTION 27-1. PUR­ POSE. It is the purpose of this Ordinance to provide for the regulation of the nature and frequency of garage sales, in order to insure public safety, provide proper parking control ana to prevent any an­ noyance or harm which might otherwise occur from the uncontrolled operation of such sales in districts not zoned for commercial use. S E C T I O N 2 7 - 2 . DEFINITION. For purposes of this ordinance: The term "garage sale" shall mean and include all sales entitled "garage sale", "lawn sale", r'attic sale", " r u m m a g e s a l e " , "basement sale", "flea market sale", or any similar casual sale of tangible personal property which is advertised by any medns whereby the public at large is or can be made aware of said sale. ' SECTION 27-3. LIN- CENSE - FEE. It shall be unlawful for any person, firm or corporation to conduct any garage sale in the City of McHenry without first filing with the City Clerk the information hereinafter specified and obtaining from the City Clerk a license to do so, to be known as a "garage sale , license". Each license issued pursuant to this Ordinance shall be prominently displayed on the premises upon which the garage sale is conducted throughout the entireperiod of the licensed sale. The fee for such license shall be $5.00. SECTION 27-4. IN­ FORMATION TO BE FILED. The information to be filed with the City Clerk pursuant to this Ordinance shall be as follows: A. Name of the person, firm, group, corporation, association, or organization conducting said sale. B. The address at which said sale is to be conducted. C. The number of days of the proposed sale. D. The date on which the licensee last applied for a garage sale license. E. The last two previous dates on which a garage sale was conducted at the same address. F. A statement that the person, firm, or corporation conducting said sale is the owner or lessee of the premises on which the sale is to be conducted. G. No more than two (2) garage sales shall be conducted on the same premises by the same household within any twelve (12) month period, nor more than one (1) sale within any seven (7) day period. No person, firm or corporation shall conduct any garage sale on premises not owned or leased 'by such person, firm or corporation. SECTION 27-6. TIME LIMITATIONS. No garage sale shall be conducted over a period of more than three (3) consecutive calendar days, nor shall any such sale begin before 9:00 A.M. or continue later than 5:00 P.M. on any given day. SECTION 27-7. TYPES OF MERCHANDISE. Garage sales shall be limited to the sale of household goods and furnishings which nave been in use in the dwelling unit located on the premises on which such sales are con­ ducted. No person, firm or corporation shall, at any garage sale, sell at retail any goods purchased or acquired in wholesale lots. SECTION 27-8. SIGNS. Any person, firm or corporation licensed under the provisions of this Ordinance may erect two (2) signs advertising the licensed sale. One such sign shall be located on the premises where the sale is to take f>lace, and the other shall be ocated at the nearest major intersection to the sale Eremises, giving directions ) the sale. No such sign shall be erected on any public right-of-way. All signs shall be removed no later than three (3) hours after conclusion of the sale. SECTION 27 9. PERSONS AND SALES EXCEPTED. The provisions of this Or­ dinance shall not apply to or affect the following persons or sales: A. Persons selling goods pursuant to an order or process of a Court of com­ petent jurisdiction. B. Persons acting in ac­ cordance with their powers and duties as public officials. C. Any persons selling or advertising for sale an item or itmes of personal property which are specifically named or described in the ad­ vertisement and which separate items do not exeed five (5) in number. D. Any sale which falls within the provisions of Chapter 121V^, Sections 157.1 et seq. of the Illinois Revised Statutes, as amended. E. Any sale conducted by a charitaDle or religious organization where the sale is being held entirely as a fund-raising activity for said organization., SECTION 2. PENALTY. Any person, firm, or cor­ poration violating any provision of this Ordinance shall be fined not less than ten dollars ($10.00), nor more than five hundred dollars ($500.00). Each day on which a violation of this Ordinance exists or con­ tinues shall be deemed a separate offense. SECTION 3. All Or­ dinances and parts of Or­ dinances in conflict herewith are hereby repealed. SECTION 4. This Or­ dinance shall be published in pamphlet form by and under the authority of the cor­ porate authorities of the City of McHenry, Illinois. SECTION 5. This Or­ dinance shall be in full force and effect from and after its passage, approval and blication as provided by aw.
