Her idea was that no one could mistake it as her own joint tenancy with right of survivorship makes it un­ necessary for an estate to go through probate if I do not own a car, and the value of my personal possessions, such as clothes and fur­ nishings, is very low? Is it necessary to have a will?" -- - Catherine A. Answer -- No, a small estate does not have to go through probates But' Catherine should have a will. Question "How can a widow of 78 set up stocks and bonds to avoid probate after death without entering into a trust agreement with someone? I would like to set up stocks with my brother who lives in another state. My broker says I can do it without any problems. My banker says I would have to pay a gift tax on half the stock. But I can't afford that. I need the dividends." -- Mary V.H. Answer -- Mary should not depend on her broker or her banker for advice that will be binding if she follows it. She should get a lawyer and-or a C.P.A. or public accountant to advise her. It will be cheaper than making a mistake. Question -- "I understnad that three witnesses to our signatures are required on wills in my state. We are here all alone, my wife and I, and we find it difficult getting witnesses to the signing of pur two wills. What can we do? -- Matthew W. Answer -- No matter how small the estate, Matthew and his wife need a lawyer. A lawyer will supply the witnesses. Some lawyers are expensive. Some are not. They can shop around, telephone some lawyers and ajsk at the state bar association office. Any law office can give Matthew the address. He had better not monkey around with his wills. It is awful the amount of trouble that can be the lot of a survivor when there is a poorly drawn will. Question -- "With the current high lawyer fees is there anything a layman can do to minimize or eliminate the need for an attorney? Do you know of any books that give the porcedural steps in processing a will? -- W.E.B. Answer -- There once was a book on how to avoid probate. It sold like cheap gold until its author got into a lot of trouble because so many who followed the advice in the book also made a lot of trouble for their survivors who couldn't follow such advice/ I would not fool around with my will. I love the people who, God willing, will sur­ vive me. Question -- "Can my wife and I draw up our own wills in the form that I read about called a holograph? Just what is a holograph?" -- Wyeth G. Answer -- A holograph is a will, or other document, that is written entirely in the handwiring of the author. My favorite aunt disposed of her estate by a holographic she copied it. There were no errors in transcribing. As I understand it, any error in handwriting could invalidate a holographic will. Again -- Wyeth should consult a lawyer. I am not drumming up business for lawyers, who are creatures I try to avoid. They are a necessary evil. Lawyers, it seems at times, exist for the purpose of circumventing the law through loopholes. While I do not subscribe to Shakespeare's advice in the play, "Henry VI," which said, "The first thing we do, let's kill all the lawyers," I avoid them wheneyer possible and suffer them cautiously in the matter of wills. Question -- "I will soon be 65. My employer has a pension plan that I can take as a lump sum settlement for a considbrable amount. Can I use that sum to roll it over into an individual retirement account or invest it in tax free bonds or insurance annuities? -- Marion E. Answer -- It depends on the amount Marion can have at his disoosal. On large amounts, a roll over could be desirable. On relatively small amounts, the tax would be too small to be considered a problem and, therefore, it would be better not to roll over. Marion by all means should consult with an expert tax person. Question -- "My parents are past 65 and recent im­ migrants; permanent residents of the U.S. since last August. They are not eligible for supplementary income and Medicaid because of their assets. Not eligible either for Meidcare yet, as they haven't lived in the U.S. for five years. They need major medical coverage insurance. How can they get it? -r Lena C. Answer -- How fortunate for Lena that her parents, newcomers to the U.S., are so well-fixed financially that they don't qualify for SSI and Medicaid. Lena should consult with several in­ surance brokers. A good one can solve the problem quickly. Question -- "I was a military wife for 28 years when I was divorced six months ago. My husband, a retired Navy captain, earned a large salary all those years. His retirement pay is about $28,000. He has cancer of the liver with just a few short months left - except God gives a miracle. Am I eligible for Social Security payments under his account? I am past 62." -- Edna Z. Answer t Yes, Edna is eligible if she has not remarried. Good luck! Question -- "What is the law on royalties from published material if I apply for SS at age 62 next April? If I'm successful as a writer before 65 will my royalties be taxed?"--Margie H. Answer--Everybody at whatever age must pay taxes on earned income, depending on deductions and standard exemptions. I am happy to advise Margie that I know, through personal experience, that SS income is not affected by royalties from published material. Question "I am 62 and never worked under SS. My husband and I walked into a church in Baltimore in 1940 and said our marriage vows at the altar. After raising four children, now all over 25, we decided to get married in the courthouse in Baltimore two years ago. My husband is drawing SS. He is 67. Am I eligible to draw SS on this past work record?" - - Mrs. Louis P. Answer - A great big resounding YES! to Mrs. Louis. Question -- "I am now 52 and hope to retire at 62. I understand that my SS benefit will be about 20 percent less than it would be at 65. But what about Medicare? Are there any Medicare benefits for those who retire at 62?" Jeannette W. Answer -- Jeannette is planning to collect SS far in the years ahead. But things may change. The answer in 1980 is no, she must be 65 to come under Medicare and I think that is right and just. Medicare was established to help save older people from disaster because of illness, not to take away all risk. Fifty-two-year-old Jeannette won't have to worry about Medicare, or no Medicare, until 65-year-old Jeannette is face-to-face with D-Day, 13 years from now. How nice! Backs Jr., son of» Leo C. Backs, Jr., of -4601 N. Wilmot, McHenry, recently participated in ^exercise "MAGEX-80" in Korea. He is a member of the 2nd battalion, 12th Marines, based on Okinawa. The month long Marine Amphibious brigade exer­ cise involved more than 3,000 Marines from Okinawa and Iwakuni, Japan, The cold- weather training began with small unit tactics and progressed through the battalion and regimental levels of tactical ^em­ ployment of forces. In the final stage, all units were integrated and exercised the capabilities of the Marine air-ground team. The Marines had the opportunity to visit Seoul, Korea after the exercise. James Thompson ordered State Bureau of the Budget Director Robert Mandeville to review all state spending plans. "It appears that federal aid cuts under active con­ sideration by the President and Congress could have a significant impact on state and local programs, not only in Fiscal Year 1981, buy also in the six and one-half months remaining in federal FY 1980. We need to be ready to respond quickly when the federal cuts become final," said Thompson. Navy Seaman ""Recruit George L. Tissen Jr., son of Mar<on S. Tissen of Route 2, McHenry, has completed recruit training at the Naval Training center, San Diego. During the eight-week training cycle, he studied general military subjects designed to prepare him for further academic and on- the-job training in one of the Navy's 85 basic occupational fields. Included in his " studies were seamanship, close- order drill, Naval history and first aid. Personnel who complete this course of in­ struction are eligible for three hours of college credit in Physical Education and Hygiene. He joined the Navy in December, 1979.
