Illinois, by its duly elected Board of Trustees, did enact Or- , dinance No. 79-0-17, entitled 'MUNICIPAL UTILITY TAX" and; WHEREAS, there is now pending in the Circuit Court of Cook County an action entitled Charles A. Geto, individually and on behalf of all person^ similarly situated v. City of Chicago, et a]., which action challenges the authority of Illinois municipalities to impose a utility tax pursuant lo Ch. 24, Illinois Revised Statutes, Sect. 8-11-2, and said action remains pending and undetermined, and; WHEREAS, the President and the Board of Trustees of the Village of Lakemoor, although tne Village has not been made a party to said proceedings, has determined that it is in the best interests of the citizens of the Village to await a determination of said proceeding before imposing these taxes, and; W H E R E A S , s o m e revenues have already been collected and received pursuant to Ordinance No. 79-0-17; NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES of the VILLAGE OF LAKEMOOR, McHenry County, Illinois, as follows: Section I.
